New York's Marijuana Regulation and Taxation Act (MRTA) authorized on-site cannabis consumption licenses when recreational cannabis was legalized in March 2021. However, as of early 2026, the Office of Cannabis Management (OCM) has not yet begun issuing consumption lounge licenses. Are there any legal cannabis lounges in New York?

Can I smoke weed at a NYC dispensary?

No. Licensed dispensaries in New York cannot allow on-site consumption. You cannot open or consume cannabis products inside a dispensary. Some dispensaries have nice lounge-like decor, but this is just for browsing — not consumption.

Where can I legally consume cannabis in New York right now?

You can legally consume in private residences (with owner permission) and generally in public places where tobacco smoking is allowed — mainly sidewalks. You cannot consume in parks, restaurants, bars, vehicles, or near children. Many hotels prohibit cannabis; ask before booking.

Did NYC opt out of consumption lounges?

No! New York City did NOT opt out of consumption lounges. However, 876 of the state's 1,520 municipalities did opt out by the December 2021 deadline. This means NYC is expected to be a primary market when lounges finally launch.

Can I open a cannabis lounge in New York?

Not yet. OCM is not currently accepting consumption lounge license applications. When they do, expect requirements including property ownership/lease, municipal approval, detailed business plans, and compliance with buffer zones. 50% of licenses are reserved for Social and Economic Equity applicants.
