The Darren Wesley 'Ato' Hall Compassion Act passed in 2021 and created the Alabama Medical Cannabis Commission (AMCC), but license awards were tied up in litigation for years afterward. That changed on December 11, 2025, when the AMCC voted to approve dispensary licenses, and on January 8, 2026, three companies were issued licenses: CCS of Alabama, GP6 Wellness, and RJK Holdings AL. A fourth award, to Yellowhammer, was stayed pending an administrative challenge.
Callie's Apothecary, operated by CCS of Alabama, opened in Montgomery on June 4, 2026 as the state's first legally operating dispensary. A second Callie's opened at 309 Battle Street West in Talladega on August 28, 2026, and a third, in Bessemer near Birmingham, was expected in September 2026. GP6 Wellness has been building out BamaBloom dispensaries in Athens and Birmingham, also targeted for September 2026, with a third GP6 site approved for Attalla in Etowah County, and RJK Holdings AL has approved sites planned for Oxford, Mobile, and Daphne. That is the whole approved map: nine cities across three licensees. CCS moved its third site from Cullman to Bessemer before opening, so Cullman is not an approved location.
Recreational cannabis is illegal statewide - a misdemeanor on a first personal-use offense, with felony exposure for repeat or larger-quantity possession. Only registered patients with a valid Alabama medical cannabis card may purchase, and only in person; the program does not allow delivery.
Separately, hemp-derived THC products (HB 445, fully effective January 2026) are regulated by the ABC Board - sold only in licensed stores to buyers 21+, capped at 10 mg THC per serving and 40 mg per package, no delivery. Smokable hemp is banned outright: since July 1, 2025, selling or simply possessing hemp flower, pre-rolls or hemp cigars is a Class C felony carrying up to ten years, and prosecutors have applied the same reading to THC vapes. Retail sales also carry a 10 percent excise tax. This is a separate system from the AMCC medical program.
