Arkansas legalized medical cannabis when voters approved Amendment 98 in November 2016, and the first legal sale in the state happened in Hot Springs on May 10, 2019. Active patient cards kept climbing anyway, reaching 119,074 in July 2026.

At the register the bill carries three layers of tax: the general state sales rate of 6.5 percent, a medical marijuana privilege charge of 4 percent, and whatever local rate the city and county set, which usually totals somewhere between 11 and 13 percent. Cards cost $50 through the Department of Health, run up to a year, and require a written certification from an Arkansas-licensed physician.

Two things changed the ground under this program recently. The Eighth Circuit cleared the way for Arkansas to enforce its intoxicating-hemp ban in June 2025, which pulled delta-8 gummies and hemp THC vapes off gas station shelves and pushed those buyers toward licensed dispensaries. Then in December 2025 the Arkansas Supreme Court ruled that the General Assembly can amend a voter-approved constitutional amendment, which means the rules governing Amendment 98 can now be rewritten in the Capitol rather than at the ballot box.
