San Pablo Avenue Cannabis Guide: Berkeley, California

Berkeley legalized ahead of the state, twice. The city was regulating medical cannabis dispensaries when most of California was still arguing about whether Proposition 215 meant anything, and Berkeley Patients Group has been operating continuously since 1999 - the longest run of any dispensary in the country. That history shows up in how retail works here: the stores are established, staffed by people who have been doing this for years, and treated by the city as ordinary regulated businesses rather than an experiment.

Municipal code section 12.26.035 sets the local ground rules for recreational cannabis, permitting consumption in private residential units or approved cannabis consumption lounges. That lounge language has been on the books longer than AB 1775, the 2024 state law that took effect in January 2025 allowing cafes to serve food and host live performances - and yet no cannabis lounge operates in Berkeley as of September 2026, despite Berkeley Patients Group having pushed for years to open one. San Francisco, across the bay, adopted its own cannabis cafe ordinance effective August 2026.

The tax picture is the quiet advantage. Berkeley section 9.04.136 holds the cannabis business tax at $25 per $1,000 of gross receipts, or 2.5 percent, well under what Oakland, San Jose and most Southern California cities charge. Combined with the state excise rollback to 15 percent in October 2025, that keeps Berkeley totals competitive with anywhere in the East Bay. Retail sits where the commercial corridors run: San Pablo Avenue in west Berkeley, Telegraph Avenue near campus, and Sacramento Street in the south-central flats. Those three corridors are the whole retail map, and each store draws from far beyond its own blocks.

California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Since July 2021 a single agency, the Department of Cannabis Control, licenses growers, manufacturers, distributors, testing labs, retailers and delivery. The result is the biggest legal market anywhere - about 1,250 active storefront retail licenses - sitting on top of a stubborn unlicensed one that still accounts for roughly 60% of what Californians actually consume.

The tax math shifted twice in twelve months. A scheduled increase pushed the state excise tax from 15% to 19% of gross receipts on July 1, 2025. Assembly Bill 564, signed September 22, 2025, reversed it: the rate returned to 15% on October 1, 2025 and is locked there through June 30, 2028, with a review starting in the 2028-29 fiscal year. On top of the excise you pay 7.25% state sales tax plus district add-ons, plus whatever your city charges - 10% in Los Angeles, 7% in Santa Ana, up to 5% in Oakland, 4% in Sacramento, nothing at all in San Francisco, which suspended its local cannabis tax.

Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.

Two brands are impossible to miss in California: STIIIZY, which runs both a vape line and its own dispensaries from downtown Los Angeles outward, and Cookies, whose licensed flower lines and its own stores in Fresno, Hayward, Modesto and Redding helped define the modern menu. Papa & Barkley, founded in Humboldt County, is the reference point for balms and tinctures and its ratio products stock wellness shelves statewide. Beyond those, buy by farm and category: Sonoma and Humboldt sun-grown flower, solventless hash from small Emerald Triangle processors, and low-dose beverages that have taken over drink coolers since AB 8 cleared hemp seltzers out of grocery stores.

The 2026 story is a market that stopped growing and started consolidating. Licensed retailers rang up $956.7 million in the first quarter of 2026, down from $976.5 million a year earlier, while the Unified Cannabis Enforcement Task Force has destroyed more than 317 tons of illegal cannabis since 2022. AB 8 closed the intoxicating-hemp channel that vape stores had been running, and AB 1775 lounges are opening a hospitality lane in the cities that opted in. Expect more single-store closures, more delivery-only licenses, and more cities revisiting retail bans as budget gaps widen.
