Consumption in public is an infraction, and in a city where the beaches are state-run and the harbor is county-operated, that ban covers nearly every outdoor space a visitor would think of using. The 15% state excise applies wherever the sale occurs, following the AB 564 rollback on October 1, 2025.

The licensed retail picture in south Orange County is thin, which makes the geography matter. The single permitted storefront in this part of the county is on Moulton Parkway in Laguna Woods, about twenty minutes inland via the 73 or Crown Valley Parkway. Beyond that, Santa Ana's cluster around Dyer Road and Grand Avenue and the Costa Mesa storefronts strung along Newport Boulevard and Harbor Boulevard are roughly forty minutes north. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.
