Downtown San Jose is the government, transit and nightlife core of a city of a million people - City Hall on East Santa Clara, the SAP Center at the western edge, San Jose State pressed against the eastern side, and a ring of residential towers that went up over the past fifteen years. Unlike San Francisco or Oakland, this downtown was never the retail center of its own metro, and cannabis retail reflects that: it is present but not abundant.
The reason is regulatory rather than cultural. San Jose froze its cannabis business count at the sixteen operators grandfathered in when the city authorized adult-use sales, and it has not opened new storefront applications since. Measure U, passed by voters in 2010 and codified in Chapter 4.66 of the municipal code, sets the marijuana business tax at 10% of gross receipts - one of the highest municipal rates in California, and one that is baked into every shelf price you see. Add 15% state excise and 10% Santa Clara County sales tax at the register and your total runs roughly a quarter above the tag.
The retail geography downtown is short to describe. Purple Lotus operates at 66 West Santa Clara Street, a block from the light rail transit mall. Its second location sits at 752 Commercial Street just north of the freeway, and the 10th Street corridor holds Harborside at 1365 North 10th and The Cake House at 1075 North 10th. Airfield Supply Co. on Coleman Avenue and Caliva on South 7th Street bracket the district on either side.
California Statewide Context
California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Since July 2021 a single agency, the Department of Cannabis Control, licenses growers, manufacturers, distributors, testing labs, retailers and delivery. The tax math shifted twice in twelve months. A scheduled increase pushed the state excise tax from 15% to 19% of gross receipts on July 1, 2025. Assembly Bill 564, signed September 22, 2025, reversed it: the rate returned to 15% on October 1, 2025 and is locked there through June 30, 2028, with a review starting in the 2028-29 fiscal year. On top of the excise you pay 7.25% state sales tax plus district add-ons, plus whatever your city charges - 10% in Los Angeles, 7% in Santa Ana, up to 5% in Oakland, 4% in Sacramento, nothing at all in San Francisco, which suspended its local cannabis tax.
Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.
Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.
