Brookvale Cannabis Guide: Fremont, California

Fremont was stitched together in 1956 out of five separate farm towns - Centerville, Niles, Irvington, Mission San Jose, and Warm Springs - and that history still shapes how people move around a city of roughly 230,000 spread across 90-plus square miles. The Tesla plant on Fremont Boulevard, the biotech and hardware campuses off Kato Road, and two BART stations pull commuters in from all over southern Alameda County. What none of that produced is a cannabis store.

The city ordinance prohibits commercial cannabis activity of every type, and the Department of Cannabis Control's local-ordinance file lists Fremont under a full ban on both storefront and delivery businesses. That means no licensee may be based here. It does not mean you are cut off: DCC rules let a licensed retailer deliver into any California jurisdiction, and SB 1186 has barred cities from blocking medicinal deliveries since January 1, 2024. Personal possession of an ounce and a six-plant home grow stay legal citywide under Proposition 64.

If you would rather buy in person, the nearest licensed counters form three clusters. Foothill Boulevard in Hayward carries Garden of Eden at 21227 Foothill and a second licensed retailer a few blocks up at 22701 Foothill; Cookies Hayward sits downtown at 1004 B Street. Union City has Flor at 31000 Courthouse Drive and Lemonnade at 30545 Union City Boulevard, both an easy hop up Mission Boulevard or the Nimitz. San Leandro adds Harborside on Marina Boulevard and NUG Wellness on Teagarden Street.

California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Since July 2021 a single agency, the Department of Cannabis Control, licenses growers, manufacturers, distributors, testing labs, retailers and delivery. The result is the biggest legal market anywhere - on the order of 800 licensed storefronts - sitting on top of a stubborn unlicensed one that still accounts for roughly 60% of what Californians actually consume.

The tax math shifted twice in twelve months. A scheduled increase pushed the state excise tax from 15% to 19% of gross receipts on July 1, 2025. Assembly Bill 564, signed September 22, 2025, reversed it: the rate returned to 15% on October 1, 2025 and is locked there through June 30, 2028, with a review starting in the 2028-29 fiscal year. On top of the excise you pay 7.25% state sales tax plus district add-ons, plus whatever your city charges - 10% in Los Angeles, Oakland and Santa Ana, 4% in Sacramento, nothing at all in San Francisco, which suspended its local cannabis tax.

Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 separately bars locals from blocking medicinal deliveries.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and pulled smokable hemp, hemp pre-rolls and synthetic cannabinoids like delta-8 and HHC out of gas stations and vape shops - intoxicating product now belongs to licensed dispensaries. And AB 1775 cafes are finally real: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's took effect August 23, 2026, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.

Two brands are impossible to miss in California: STIIIZY, which runs both a vape line and its own dispensaries from downtown Los Angeles outward, and Cookies, whose Melrose store and licensed flower lines helped define the modern menu. Papa & Barkley, based in Eureka, is the reference point for balms and tinctures and runs a dispensary, spa and lounge on Broadway in Humboldt County. Beyond those, buy by farm and category: Sonoma and Humboldt sun-grown flower, solventless hash from small Emerald Triangle processors, and low-dose beverages that have taken over drink coolers since AB 8 cleared hemp seltzers out of grocery stores.

The 2026 story is a market that stopped growing and started consolidating. Licensed retailers rang up $956.7 million in the first quarter of 2026, down from $976.5 million a year earlier, while the Unified Cannabis Enforcement Task Force has destroyed more than 317 tons of illegal cannabis since 2022. AB 8 handed dispensaries the intoxicating-hemp customers who used to shop at vape stores, and AB 1775 lounges are opening a hospitality lane in the cities that opted in. Expect more single-store closures, more delivery-only licenses, and more cities revisiting retail bans as budget gaps widen.
