Huntington Beach is the closest thing Orange County has to a cannabis policy cliffhanger. In November 2022 voters passed Measure O, a cannabis business tax setting 6% on retailers and up to 1% on other operators, projected to bring in $300,000 to $600,000 a year. The council followed by moving to replace the city's prohibition and drafting a land-use map that would keep any cannabis storefront 600 to 1,000 feet from schools, parks, daycare centers and youth facilities, with operator permits once expected in 2023.

Years later the storefronts are still not here. As of September 2026 no licensed dispensary appears in the city, and municipal code language prohibiting dispensaries remains on the books. That leaves a city of nearly 200,000 people, ten miles of coastline and millions of annual visitors buying entirely by delivery - which is legal and unaffected by anything the city does, since state regulation lets licensed retailers deliver into any California jurisdiction.

The practical retail map runs inland and north. Stanton, about fifteen minutes up Beach Boulevard, permits licensed retail and is the closest counter for most of the city. Santa Ana's roughly twenty stores are twenty minutes east along the 405, and Costa Mesa's licensed retailers sit a similar distance southeast. Those three clusters cover Huntington Harbour, the downtown pier area, the Edinger and Warner corridors and the Seacliff and Sunset Beach ends with routine daily service.

California Statewide Context

California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.
