San Jose is the largest city in Northern California and it has sixteen dispensaries. That number is not an accident of demand - it is a cap written into Municipal Code Chapter 6.88 that has held since 2014, several years before adult-use sales even began. Regulation runs through the Office of Cannabis Regulation inside the San Jose Police Department, which makes compliance here more paperwork-heavy than in Oakland or Sacramento.

The upside of a hard cap is stability. The sixteen licensed operators have had years to build inventory depth, delivery fleets and customer bases that stretch well past city limits into Santa Clara, Sunnyvale, Cupertino and Campbell, most of which permit little or no retail of their own. The downside is convenience: entire districts of a million-person city sit twenty minutes from the nearest counter, which is why San Jose has one of the highest delivery shares of any California market. The city moved in recent years to ease some of its stricter operating rules to help licensees stay viable as statewide prices fell.

Retail clusters follow the industrial and commercial zoning near the airport and downtown. The Coleman Avenue corridor between downtown and Mineta San Jose holds Airfield Supply Company. California Statewide Context

California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.
