Solana Beach runs about three and a half square miles from the San Elijo Lagoon down to Via de la Valle, with the bluffs, the Cedros Avenue design showrooms and a Coaster station that has served as north county's main rail stop since 1995. Its cannabis position was settled at the ballot box rather than in a council chamber: a citizens' initiative on the November 2020 ballot proposed permitting up to two retailers plus delivery and cultivation, drew organized opposition from the school board and neighborhood groups, and lost by a wide margin.

Six years on, nothing has replaced it. The state license database shows no active cannabis permit of any type at a Solana Beach address as of September 2026, and the city has not opened a permit process. Personal rights are unaffected: an ounce of flower for anyone at or above the legal age, a separate quarter-ounce ceiling on concentrate, half a dozen plants screened from the street at one address, and no using it anywhere the public can go. The 15% state excise applies wherever you buy, following the October 2025 rollback from 19%.

Geography does most of the work here. Coast Highway 101 runs straight out of the north end of the city and into Encinitas, where four licensed retailers operate between the 200 block of North El Camino Real and the 1000 block of the highway. That two to three mile stretch is the closest permitted frontage to any Solana Beach address, and it is the corridor competing for this city's customers every day.

California Statewide Context

California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Since July 2021 a single agency, the Department of Cannabis Control, licenses growers, manufacturers, distributors, testing labs, retailers and delivery. The result is the biggest legal market anywhere - on the order of 800 licensed storefronts - sitting on top of a stubborn unlicensed one that still accounts for roughly 60% of what Californians actually consume.

On top of the excise you pay 7.25% state sales tax plus district add-ons, plus whatever your city charges - 10% in Los Angeles, Oakland and Santa Ana, 4% in Sacramento, nothing at all in San Francisco, which suspended its local cannabis tax.

Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 separately bars locals from blocking medicinal deliveries.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and pulled smokable hemp, hemp pre-rolls and synthetic cannabinoids like delta-8 and HHC out of gas stations and vape shops - intoxicating product now belongs to licensed dispensaries. And AB 1775 cafes are finally real: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's took effect August 23, 2026, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.
