Georgia has extremely limited legal cannabis access. Recreational marijuana is completely illegal statewide—possession of any amount is a criminal offense. The only legal option is the state's Low-THC Oil Registry for patients with qualifying medical conditions.
The program allows registered patients to possess up to 20 fluid ounces of low-THC oil (5% THC maximum, must contain equal or more CBD). Products available: tinctures, capsules, topicals, lozenges. No flower, no edibles, no vaping, no smoking permitted—even for medical patients.
As of January 2026, over 33,700 patients are enrolled. PTSD and intractable pain comprise 75%+ of registrants. Dispensaries opened in 2023 after years of delays. Currently ~17-19 licensed dispensaries and 56+ independent pharmacies carry products.
Important: Several cities have decriminalized possession of <1 oz (Atlanta, Savannah, Athens, Augusta, Macon). However, state law still applies—you can still be arrested under state law even in decriminalized cities. This is NOT legalization. Penalties remain harsh: <1 oz misdemeanor (up to 1 year jail, $1,000 fine), >1 oz felony (1-10 years prison).
