Atlanta decriminalized possession of less than one ounce in 2017—reducing penalties to a $75 fine with no jail time. This was groundbreaking for the South, and a 2025 study showed the policy led to 19.7% reduction in violent crime as police resources shifted.

However, this is NOT legalization. State law still applies. Georgia State Patrol and many officers still charge under state law. You can still be arrested even within Atlanta city limits.

Medical patients access low-THC products at dispensaries in metro Atlanta suburbs: Chamblee (Botanical Sciences), Marietta (Botanical Sciences, Trulieve), Stockbridge (Botanical Sciences), Decatur (Fine Fettle), Smyrna (Fine Fettle). No dispensaries within Atlanta city proper.

Hemp-derived THC products (delta-8, delta-10) are more widely available at smoke shops, but regulations are tightening. The state is studying intoxicating hemp products for potential restrictions.

Georgia has extremely limited legal cannabis access. Recreational marijuana is completely illegal statewide—possession of any amount is a criminal offense. The only legal option is the state's Low-THC Oil Registry for patients with qualifying medical conditions.

The program allows registered patients to possess up to 20 fluid ounces of low-THC oil (5% THC maximum, must contain equal or more CBD). Products available: tinctures, capsules, topicals, lozenges. No flower, no edibles, no vaping, no smoking permitted—even for medical patients.

As of January 2026, over 33,700 patients are enrolled. PTSD and intractable pain comprise 75%+ of registrants. Dispensaries opened in 2023 after years of delays. Currently ~17-19 licensed dispensaries and 56+ independent pharmacies carry products.

Important: Several cities have decriminalized possession of <1 oz (Atlanta, Savannah, Athens, Augusta, Macon). However, state law still applies—you can still be arrested under state law even in decriminalized cities. This is NOT legalization. Penalties remain harsh: 1 oz felony (1-10 years prison).

Georgia does NOT permit cannabis delivery. All purchases must be made in-person at licensed dispensaries or participating independent pharmacies with valid Low-THC Oil Registry Card.
