Midtown Gary Cannabis Guide: Gary, Indiana

Gary was built by U.S. Steel in 1906 and named for the man who ran it, and the mill along the lakefront is still the largest integrated steelworks in North America even as the city around it shrank by more than half. Indiana Dunes National Park wraps the eastern lakefront, Marquette Park and Miller Beach hold some of the best shoreline in the state, and the casino and airport sit on the west side. The population loss reshaped everything except the state cannabis statute, which applies here as fully as anywhere.

What makes this market unusual is being wedged between two legal states. Illinois retail is about fifteen minutes west - the Calumet City stores just over the line, with more across the Chicago Southland - and the Michigan cluster at New Buffalo is roughly forty minutes east on I-94, where JARS, DACUT, King of Budz, and the Pokagon Band's Rolling Embers all operate within a few minutes of Exit 1. Lake County prosecutes possession normally, and the Borman and Toll Road corridors that carry that traffic are heavily worked.

In-state retail is hemp. Counters run along Broadway through the older commercial blocks, on Grant Street, along Ridge Road through Glen Park, and out toward Lake Street in Miller, with convenience stores filling gaps in between. Beverage coolers appear in the larger groceries and liquor stores. Nothing on any of those shelves is marijuana, and the price gap against Illinois retail is wide enough that hemp holds real market share here.

Indiana is ringed on all four sides by states that sell legal cannabis and still has none of its own. As of September 2026 there is no adult-use market here, no medical program, no dispensary license to apply for, and no state agency that issues one. The single cannabis product Indiana law affirmatively permits is low-THC hemp extract, legalized by Senate Enrolled Act 52 in 2018, capped at three-tenths of a percent delta-9 THC and required to carry a certificate of analysis plus a scannable QR code.

Possession of marijuana, hash oil, hashish, or salvia is a Class B misdemeanor under Indiana Code 35-48-4-11, punishable by up to 180 days in jail and a fine of up to $1,000. A prior drug conviction raises it to a Class A misdemeanor, and a prior conviction paired with at least 30 grams of marijuana or 5 grams of hash oil makes it a Level 6 felony. Enforcement varies sharply by county: Marion County has declined to charge simple possession of an ounce or less since 2019, while a 2025 law created a review board to examine prosecutors who categorically refuse to charge an offense.

What actually sells here is hemp-derived THC. Gummies, tinctures, capsules, and seltzers made from hemp move through vape stores, liquor chains, and grocery coolers with almost no state rules attached - no milligram ceiling per container, no retailer permit, no statewide minimum age. Smokable hemp flower is the loud exception: manufacturing, delivering, or publicly possessing it is a Class A misdemeanor, and the Seventh Circuit let that ban survive.

The federal calendar now moves faster than the Statehouse, which let two of its own hemp bills die rather than pass rules for the products already sitting on Indiana shelves. A spending law signed in November 2025 redefined hemp around a 0.4 milligram total-THC ceiling per retail container; a stopgap signed September 2, 2026 shifted most of that to December 11, 2026, while products built on cannabinoids the plant cannot produce on its own hit their wall on November 12, 2026.

There are no Indiana marijuana brands to recommend, because Indiana licenses no cultivators and no dispensaries. On the hemp side, the largest company in the category is headquartered here: 3CHI, founded by a biochemist and run out of offices in Fishers, Carmel, and Indianapolis, was the first commercial developer of hemp-derived delta-8 and now sells gummies, tinctures, and cartridges nationally. Hemp THC beverages have the widest legitimate Indiana distribution of anything in this space - Wynk and BUZZN are two of the brands stocked across Total Wine and More, The Fresh Market, and Crown Liquors locations around the state. Whatever you buy, check the QR code on the label and read the certificate of analysis before you pay; Indiana requires that code but does not police what is behind it.

Three clocks are running at once. The federal hemp redefinition signed November 12, 2025 splits into two dates after the September 2, 2026 stopgap - synthetic-conversion cannabinoids like delta-8 and HHC lose their federal cover on November 12, 2026, and most everything else follows on December 11, 2026. The Statehouse has repeatedly failed to write its own rules ahead of that, with the 2025 regulatory bill dying on the session's last day and the 2026 alignment bill dying in the House, which leaves an unregulated Indiana market about to be regulated by Washington instead. Meanwhile Governor Braun said in March 2026 that with four legal neighbors Indiana will probably have to address marijuana, and Senator Mike Bohacek is drafting a medical framework - but Senate leadership has not moved, and April 2026 federal rescheduling only touched state-licensed medical cannabis, of which Indiana has none.
