Asheville draws millions of visitors a year for the Biltmore Estate, the Blue Ridge Parkway, and a food, beer, and arts scene that punches well above the city's modest population. That tourism economy, combined with a countercultural reputation dating back decades, makes Asheville feel like it should have legal cannabis - and yet, like every other North Carolina city outside Cherokee, it has zero licensed marijuana retail.

What Asheville does have is genuine geographic proximity to the one legal option in the state: Great Smoky Cannabis Company sits roughly 55 miles and just over an hour southwest in Cherokee, making Asheville easily the closest major city to a real, tested marijuana purchase. Local hemp shops in the River Arts District, downtown, and West Asheville openly acknowledge this, often posting directions or informal recommendations for customers who want the real thing.

Buncombe County enforces the identical statewide possession statute found everywhere from Charlotte to the coast, and Asheville's countercultural reputation does nothing to soften it - officers here write the same citations for the same quantities as any other North Carolina department.

Given the short drive to Cherokee, Asheville arguably has the most active dual-market dynamic in the state - locals and tourists alike treat a Cherokee day trip as genuinely feasible in a way nobody in Charlotte, Raleigh, or Wilmington would consider, keeping cross-shopping between hemp and the tribal dispensary unusually common here.

North Carolina splits into two very different cannabis realities. On sovereign Eastern Band of Cherokee Indians land in the mountain town of Cherokee, Great Smoky Cannabis Company has sold adult-use marijuana to anyone 21 or older since September 7, 2024, under tribal law that state and county law enforcement cannot reach. Everywhere else in North Carolina, growing, selling, or possessing marijuana remains a state crime, and there is no medical marijuana program a patient can register with.

Simple possession of marijuana still carries real risk statewide. Half an ounce or less is a Class 3 misdemeanor with no jail time and up to a $200 fine - commonly called decriminalized, but still a criminal charge that shows up on a record. Larger amounts escalate quickly: half an ounce to 1.5 ounces is a Class 1 misdemeanor with up to 45 days, and anything above 1.5 ounces up to 10 pounds is a Class I felony. None of that applies on Cherokee's tribal land, where purchases and possession under tribal law are legal for adults.

Because North Carolina has no licensed statewide marijuana retail market, "recommended brands" outside Cherokee means product categories and nationally distributed hemp brands verified to sell into North Carolina - look for third-party lab results (a QR code or batch COA) on any hemp product before buying, since the state does not yet mandate testing.
