Jacksonville exists almost entirely because of Camp Lejeune, one of the Marine Corps' largest East Coast installations, and the adjacent Marine Corps Air Station New River. Tens of thousands of Marines, sailors, and their families cycle through the area, and that military presence shapes local cannabis policy discussions more than anything happening in Raleigh.

Marines face random drug testing and zero-tolerance THC policy under the Uniform Code of Military Justice, identical to soldiers at Fort Liberty - a hemp product bought legally at a Jacksonville smoke shop can still trigger a positive test and end a military career, regardless of North Carolina's hemp laws. Local shop owners near the base gates are well aware of this and post warnings accordingly.

Onslow County possession law tracks the rest of North Carolina exactly for civilians, with a citation and fine rather than jail time for a small amount. For Marines, though, the far more serious consequence almost always comes through military channels rather than a county courtroom.

Cherokee sits about 370 miles and a six-hour drive west of Jacksonville, among the longest such trips anywhere in the state - and for anyone in uniform, the UCMJ career risk alone makes that drive one essentially no Camp Lejeune Marine would ever take.

North Carolina splits into two very different cannabis realities. On sovereign Eastern Band of Cherokee Indians land in the mountain town of Cherokee, Great Smoky Cannabis Company has sold adult-use marijuana to anyone 21 or older since September 7, 2024, under tribal law that state and county law enforcement cannot reach. Everywhere else in North Carolina, growing, selling, or possessing marijuana remains a state crime, and there is no medical marijuana program a patient can register with.

The NC Compassionate Care Act, the state's medical marijuana bill, has passed the Senate multiple times since 2021 but has never gotten a House floor vote, and its 2025-2026 session version, House Bill 1011, has sat in House Rules since April 2025. Until it becomes law, no North Carolina physician can legally recommend cannabis and no dispensary outside Cherokee can legally sell it, regardless of diagnosis.

The rest of the state runs on hemp. Delta-8, delta-9 (low-dose, hemp-derived), and THCA products - flower, vapes, edibles, concentrates - are sold openly in smoke shops, vape stores, gas stations, and online, built on the 2018 Farm Bill's delta-9-only definition of hemp and North Carolina's lack of a state potency cap. That federal foundation is about to move: Public Law 119-37, enacted November 12, 2025, rewrote the hemp definition in 7 U.S.C. 1639o around total THC, counting THCA and delta-8, and caps consumable hemp at 0.4 mg total THC per container effective November 12, 2026. House Bill 328 would conform state law to that standard and add a 21+ purchase age; the Senate adopted the conference report 37-6 on July 2, 2026, but the House sent it back to its Rules Committee on July 30, so it was not law as of September 2026.

Simple possession of marijuana still carries real risk statewide. Half an ounce or less is a Class 3 misdemeanor with no jail time and up to a $200 fine - commonly called decriminalized, but still a criminal charge that shows up on a record. Larger amounts escalate quickly: half an ounce to 1.5 ounces is a Class 1 misdemeanor with up to 45 days, and anything above 1.5 ounces up to 10 pounds is a Class I felony. None of that applies on Cherokee's tribal land, where purchases and possession under tribal law are legal for adults.

Because North Carolina has no licensed statewide marijuana retail market, "recommended brands" outside Cherokee means product categories and nationally distributed hemp brands verified to sell into North Carolina - look for third-party lab results (a QR code or batch COA) on any hemp product before buying, since the state does not yet mandate testing. At Great Smoky Cannabis Company in Cherokee, ask staff which of their own cultivated and processed lines - grown at the tribe's Tsisqwohi (Birdtown) farm - is in stock that week; the dispensary largely sells its own vertically integrated product rather than outside brands.

The story of 2026 is a thriving, unregulated hemp market running out of runway: the federal total-THC standard in P.L. 119-37 caps consumable hemp at 0.4 mg per container on November 12, 2026, and HB 328, which would match that in state law and add a 21+ age floor, cleared the Senate 37-6 in July before the House parked it in Rules on July 30. Meanwhile Great Smoky Cannabis Company just passed two full years of adult-use sales and has filled more than 750,000 orders for customers traveling in from North Carolina, South Carolina, Georgia, and Tennessee, making Cherokee a genuine cannabis-tourism draw while the rest of the state waits on the legislature.
