East Devils Lake Cannabis Guide: Devils Lake, North Dakota

Devils Lake is defined by water that will not go away. The lake sits in a closed basin with no natural outlet, and since 1993 it has swallowed farmland, forced highways to be raised and swallowed whole townsites, growing into the largest natural body of water in the state. That transformation turned a farm town into a year-round fishing destination, and the perch and walleye traffic now shapes the local economy as much as agriculture does.

A community of about seven thousand people holding one of only eight state dispensary licenses is an oddity worth understanding. The Division of Medical Marijuana placed stores by region rather than by population, which is why Curaleaf operates here and why patients drive in from Rolette, Benson, Towner and Cavalier counties. Sales are limited to enrolled card holders, no adult-use option exists, cultivation at home is banned, and nothing is delivered anywhere in this state.

The store is at 310 Highway 2 East, on the highway commercial strip that carries almost all through traffic into and out of the city, alongside motels, fuel stops and the retail that serves both residents and the fishing crowd. Downtown along 4th and 5th Streets holds the older bar, restaurant and tackle trade in restored brick buildings. CBD and wellness products turn up in a handful of highway-strip retailers, restricted by state hemp law to non-intoxicating goods with strict container limits.

North Dakota has been a medical-only state since voters approved the Compassionate Care Act as Initiated Measure 5 in 2016. The first dispensary sales did not happen until March 2019, and the program is run by the Division of Medical Marijuana inside the Department of Health and Human Services, based at 600 East Boulevard Avenue in Bismarck. The state counted 10,317 cards issued as of August 6, 2026.

Retail here is deliberately small. State law caps the market at eight dispensing compassion centers and two manufacturing facilities, and every one of those eight storefronts is currently held by Curaleaf, Pure Dakota Health or Strive Life. Nothing is delivered, nothing is grown at home, and a patient card only protects product bought inside North Dakota from one of those eight counters. Purchases carry the ordinary 5 percent state sales tax plus city and county sales tax; there is no cannabis excise tax on top.

August 1, 2025 brought the biggest expansion the program has had. House Bill 1203 and Senate Bill 2294 added cannabinoid edibles in the form of square hard or soft lozenges capped at 5 mg of THC per serving and 50 mg per package, dropped the in-person requirement for a first certification visit so telehealth now counts, stretched patient cards from one year to two, and raised the application fee to $40. Senate Bill 2293 capped concentrate containers at one gram. Nonresidents can now get a 60-day North Dakota card.

Politically the state has narrowed but not moved. Measure 5 lost 52.55 to 47.45 percent in November 2024, the third defeat in six years. Meanwhile Minnesota opened licensed adult-use retail in September 2025 and Montana has sold adult-use since 2022, which leaves North Dakota ringed by legal stores it gives its own residents no legal way to use.

The whole state runs on three licensed operators, so there is no long brand shelf to compare. Curaleaf holds the dispensaries in Minot, Dickinson, Jamestown and Devils Lake. Pure Dakota Health holds Bismarck, Fargo and Williston. Strive Life holds Grand Forks. Products come from the two licensed manufacturing facilities, which is why the same strain names and cartridge hardware turn up in stores hundreds of miles apart. Outside the program, the only cannabinoid goods legally sold at ordinary North Dakota retail are CBD and CBG items, hemp tinctures under 30 mL and hemp topicals under 50 mg total THC per container. Delta-8, THC-O, HHC and THCP products are excluded from the state hemp definition and cannot be sold here at all.

The 2025 session was the friendliest the program has seen: lozenges, telehealth certifications, two-year cards and a one-gram concentrate cap all landed on August 1, 2025, and Senate Bill 2308 dissolved the Medical Marijuana Advisory Board. What did not change is the statutory cap of eight stores, so no new licenses are in play. The pressure now comes from outside: Minnesota licensed retail opened in September 2025 and tribal stores sit minutes from Fargo and Grand Forks, while a federal hemp redefinition signed in November 2025 takes effect November 12, 2026 and will pull most remaining intoxicating hemp products off shelves nationally.
