Chahinkapa Park Cannabis Guide: Wahpeton, North Dakota

Wahpeton sits where the Bois de Sioux and the Otter Tail meet to form the Red River of the North, which makes this small Richland County city the literal starting point of the river that defines eastern North Dakota. About eight thousand people live here, supported by the North Dakota State College of Science, the Minn-Dak sugarbeet cooperative and the farm economy of the southern Red River Valley. Breckenridge, Minnesota faces the city across the water as a functional twin.

That twin-city arrangement is why cannabis questions get complicated locally. Minnesota licensed adult-use retail statewide, North Dakota did not, and the boundary between the two runs through the middle of daily life here. Richland County holds none of the eight North Dakota dispensary licenses, so registered patients drive about fifty miles north to the Fargo store. Nothing is delivered anywhere in this state, home cultivation is banned, and a patient card carries no protection for anything purchased on the Minnesota side.

Local retail runs along Dakota Avenue through the downtown blocks and out along the highway corridors leading west toward Interstate 29 and north toward Fargo. CBD and wellness counters appear in a handful of those storefronts, all restricted to the non-intoxicating goods the state hemp chapter permits, with tinctures held to thirty milliliters and topicals under fifty milligrams of total THC. The college trade supports a small tobacco and glass presence downtown, and none of it may lawfully carry the products sold openly a few blocks east.

North Dakota has been a medical-only state since voters approved the Compassionate Care Act as Initiated Measure 5 in 2016. The first dispensary sales did not happen until March 2019, and the program is run by the Division of Medical Marijuana inside the Department of Health and Human Services, based at 600 East Boulevard Avenue in Bismarck. The state counted 10,317 cards issued as of August 6, 2026.

Retail here is deliberately small. State law caps the market at eight dispensing compassion centers and two manufacturing facilities, and every one of those eight storefronts is currently held by Curaleaf, Pure Dakota Health or Strive Life. Nothing is delivered, nothing is grown at home, and a patient card only protects product bought inside North Dakota from one of those eight counters. Purchases carry the ordinary 5 percent state sales tax plus city and county sales tax; there is no cannabis excise tax on top.

August 1, 2025 brought the biggest expansion the program has had. House Bill 1203 and Senate Bill 2294 added cannabinoid edibles in the form of square hard or soft lozenges capped at 5 mg of THC per serving and 50 mg per package, dropped the in-person requirement for a first certification visit so telehealth now counts, stretched patient cards from one year to two, and raised the application fee to $40. Senate Bill 2293 capped concentrate containers at one gram. Nonresidents can now get a 60-day North Dakota card.

Politically the state has narrowed but not moved. Measure 5 lost 52.55 to 47.45 percent in November 2024, the third defeat in six years. Meanwhile Minnesota opened licensed adult-use retail in September 2025 and Montana has sold adult-use since 2022, which leaves North Dakota ringed by legal stores it gives its own residents no legal way to use.

The whole state runs on three licensed operators, so there is no long brand shelf to compare. Curaleaf holds the dispensaries in Minot, Dickinson, Jamestown and Devils Lake. Pure Dakota Health holds Bismarck, Fargo and Williston. Strive Life holds Grand Forks. Products come from the two licensed manufacturing facilities, which is why the same strain names and cartridge hardware turn up in stores hundreds of miles apart. Outside the program, the only cannabinoid goods legally sold at ordinary North Dakota retail are CBD and CBG items, hemp tinctures capped at 30 mL and hemp topicals under 50 mg total THC per container. Delta-8, THC-O, HHC and THCP products are excluded from the state hemp definition and cannot be sold here at all.

The 2025 session was the friendliest the program has seen: lozenges, telehealth certifications, two-year cards and a one-gram concentrate cap all landed on August 1, 2025, and Senate Bill 2308 dissolved the Medical Marijuana Advisory Board. What did not change is the eight-dispensary ceiling in NDCC 19-24.1-12, and no new application period has opened. The pressure now comes from outside: Minnesota licensed retail opened in September 2025 and tribal stores sit minutes from Fargo and Grand Forks, while a federal hemp redefinition signed in November 2025 takes effect November 12, 2026 and will pull most remaining intoxicating hemp products off shelves nationally.
