Anything with more than 0.4 milligrams of total THC per container is now legally marijuana, and it can only be sold through a licensed dispensary that tests and labels it the same way it tests flower and vapes.

Adults 21 and older can possess up to 2.5 ounces of flower or 15 grams of extract, and can grow up to six plants at home (twelve per household) as long as the plants are locked up and out of public view. Recreational purchases carry a 10% state cannabis excise tax stacked on top of the regular 5.75% state sales tax and whatever local sales tax applies, for an effective rate of roughly 16.5% to 17.5% depending on the city. Delivery is still not legal for adult-use customers — SB 56 opened the door to medical-only delivery, but the Division of Cannabis Control had not finalized those rules as of September 2026, so every purchase in this guide assumes an in-person dispensary visit.
