On a separate track, the Texas Supreme Court held in May 2026 that DSHS may enforce its long-stalled Schedule I classification of delta-8 and related hemp isomers; that enforcement began July 31, 2026. Where that leaves the shelf: compliant delta-9 hemp is the legal backbone, delta-8 has been pulled, and whether smokable hemp is still available depends entirely on which store you walk into.

TCUP grew through all of this. House Bill 46, effective September 1, 2025, expanded qualifying conditions, added non-smoked inhalation, replaced the old 1%-THC cap with a 1-gram-per-package limit, and authorized growing dispensing-organization licenses from three to fifteen. Three companies dispense today, and all three deliver statewide, so a patient's zip code matters far less than it used to.
