Until then, the only licensed cannabis retail is medical. The CCA splits the state into five Health Service Areas, each served by one processor running up to five satellite dispensaries. Roughly two dozen medical dispensaries operate statewide as of September 2026, with the last region - Winchester and Charlottesville - getting its first storefront in August 2026. Patients can have product brought to them only via an in-person hand-off with an ID check at the door; there is no courier drop-off and no delivery for non-patients.

Hemp-derived THC fills the retail gap for now, capped at 2mg of THC per package under a 2023 law and sold to anyone 21+ with no medical card. A 25:1 CBD-to-THC loophole let some products exceed that cap, but it was repealed effective August 15, 2026.
