Norfolk Border Cannabis Guide: Portsmouth, Virginia

Norfolk Naval Shipyard - despite the name, physically located in Portsmouth - has repaired and built Navy vessels since 1767, making it the oldest industrial facility of its kind in the country. That federal footprint, plus a historic Olde Towne core dating to the colonial era, gives Portsmouth a split identity: naval town first, riverside city second.

A licensed dispensary does operate here: Verano's Zen Leaf on Seaboard Court, tucked off the I-264 corridor in the city's western half. Marijuana stays fully illegal on shipyard grounds regardless of anything the Commonwealth allows a few blocks away. Portsmouth's population runs smaller and older than its Hampton Roads neighbors, a demographic mix that has kept demand for a local storefront lower on the region's political radar so far.

Olde Towne's brick storefronts host a hemp seltzer shop tucked among the antique dealers, low-dose drinks and gummies that amount to the only walk-in option for anyone without a patient card. Portsmouth hasn't said anything about adult-use zoning, though as a smaller Hampton Roads city it may wait to see what Norfolk and Virginia Beach do first. The passenger ferry across the Elizabeth River still shapes daily life downtown, but for cannabis it is the Seaboard Court counter, not a Norfolk crossing, that a registered Portsmouth patient actually needs.

Virginia is a legal-to-possess, nothing-to-buy state, and that gap defines the market in September 2026. Adults 21 and older have been able to possess and grow at home since July 1, 2021, and the public-carry limit rose from one ounce to two on July 1, 2026. What never followed was a retail system - the licensing and storefront framework that turns legal possession into a place to actually buy the product.

That framework was fought over for three years. Gov. Youngkin vetoed retail bills in 2024 and 2025. Democrats won the governorship in November 2025, and the 2026 Assembly passed a new bill, which Gov. Spanberger also vetoed in May 2026 over enforcement gaps. Spanberger and legislative sponsors then wrote a fix into the state budget: House Bill 30, enacted June 29, 2026, sets a firm July 1, 2027 launch for licensed adult-use retail, regulated by the Virginia Cannabis Control Authority (CCA).

Until then, the only licensed cannabis retail is medical. The CCA splits the state into five Health Service Areas, each served by one processor running up to five satellite dispensaries. Roughly two dozen medical dispensaries operate statewide as of September 2026, with the last region - Winchester and Charlottesville - getting its first storefront in August 2026. Patients can have product brought to them only via an in-person hand-off with an ID check at the door; there is no courier drop-off and no delivery for non-patients.

Hemp-derived THC fills the retail gap for now, capped at 2mg of THC per package under a 2023 law and sold to anyone 21+ with no medical card. A 25:1 CBD-to-THC loophole let some products exceed that cap, but it was repealed effective August 15, 2026. When retail launches in July 2027, expect a 6% state excise tax (8% by 2029) plus up to 3.5% local tax - near 12.3% to 16.5% combined, below rates common in older adult-use states.

Virginia's only licensed cannabis retail is medical, run by five regional processors, each tied to one Health Service Area (HSA): AYR/Arboretum holds HSA I (Shenandoah Valley, Charlottesville, Fredericksburg) and HSA IV; Jushi Holdings, operating as Beyond/Hello, holds HSA II covering Northern Virginia; Green Thumb Industries (GTI Core) holds HSA III in Southwest Virginia; and Verano Holdings holds HSA V. Each processor sells its own house-branded flower, vapes, edibles, and concentrates - there is no multi-brand retail shelf like mature adult-use states. In the hemp aisle, look for verified national brands and always check the certificate of analysis for total THC per package; independent lab results should be posted or available on request everywhere hemp THC is sold.

The story of 2026 in Virginia is the fight over when - not whether - retail sales start. Two Youngkin vetoes (2024, 2025) and one Spanberger veto (May 2026) all delayed the market before a June 2026 budget deal locked in July 1, 2027. Watch for license applications, which the CCA starts accepting February 1, 2027; the August 15, 2026 closure of the 25:1 hemp ratio loophole has already pulled a chunk of high-potency hemp products off shelves. The medical program also just finished its rollout, with HSA I (Shenandoah Valley/Charlottesville region) getting its first dispensary, in Winchester, only in August 2026.
