What fills the gap is hemp. Wisconsin never banned smokable hemp, so THCA flower sits in jars next to delta-8 cartridges, delta-9 gummies, and canned THC seltzers in vape shops, liquor stores, groceries, and bars across the state. Wisconsin set no statewide purchase age for any of it; Wood County wrote the first local age rule in 2022 and Milwaukee followed in July 2025 with a 21-and-over ordinance carrying fines up to $1,000 per sale.

That entire market has an expiration date. The federal hemp redefinition caps finished products at 0.4 milligrams of total THC per container, and the stopgap signed September 3, 2026 pushed most of those restrictions from November 12 to December 11, leaving only cannabinoids the plant cannot produce on the original date.
