Buffalo Ridge Cannabis Guide: Cheyenne, Wyoming

Cheyenne is a capital city, a rail town and an Air Force town all at once, and each of those identities raises the stakes on a cannabis charge. The Wyoming Legislature meets a few blocks from the Capitol dome where reclassification bills have died before introduction in back-to-back sessions. F.E. Warren Air Force Base sits on the west side, where federal employment rules apply regardless of what any neighboring state allows. And the Burlington Northern yards and the Union Pacific depot anchor a workforce covered by federal transportation drug testing, where a positive result costs a job even if the product was bought lawfully in another state.

The geography is the whole story. The Colorado line is nine miles down I-25, and the first licensed adult-use stores are in Fort Collins, about 45 miles from downtown. That drive is legal in one direction only. Wyoming Highway Patrol works the I-25 and I-80 junction here, and out-of-state plates returning northbound during Cheyenne Frontier Days in late July draw plenty of attention. A misdemeanor possession count still carries a year of jail exposure, and being under the influence is separately chargeable, so a roadside admission can matter as much as a bag on the seat.

What Cheyenne does have is a hemp shelf. CBD tinctures, capsules and topicals sit in wellness shops, vape stores and pharmacies along Dell Range Boulevard near the Frontier Mall, on Lincolnway heading east and west through town, down South Greeley Highway, and in the small storefronts around Capitol Avenue and 17th Street downtown. Since July 2024 none of them can legally stock delta-8 or any other intoxicating isomer.

Wyoming is one of a shrinking handful of states with no cannabis program of any kind. Marijuana sits in Schedule I of the Wyoming Controlled Substances Act, no city or county can decriminalize on its own, and the 2015 hemp extract card for intractable epilepsy is the closest thing to a medical pathway the state has ever created. That card, issued by the Wyoming Department of Health on a neurologist's certification, covers preparations under 0.3 percent THC with a high CBD content - and it comes with no legal in-state source, which is the flaw patients have complained about since the day it passed.

Nothing loosened in 2025 or 2026. Reclassification and decriminalization bills died before introduction in consecutive sessions, and organizers of the ballot petitions have never cleared Wyoming's geographic distribution rule, which demands signatures equal to 15 percent of the last governor's race turnout in two-thirds of the counties. The 2024 attempt gathered enough raw signatures statewide and still failed because it reached the threshold in only 14 of the required 16 counties. No cannabis measure was certified for the November 2026 ballot.

The state also went the other direction on the federal question. After an April 2026 federal order moved state-licensed medical cannabis to Schedule III, Wyoming objected, held a public hearing in June and ruled in July 2026 that all marijuana - including product held under another state's medical program - stays Schedule I under Wyoming law.

Penalty math matters more here than in most states. Anything up to three ounces of plant material lands as a misdemeanor with a year of possible jail time and a fine ceiling of $1,000, and above that weight the charge turns felony, worth five years and $10,000. Concentrate is measured on a far smaller scale, and Wyoming is one of the few states that charges being under the influence as its own offense, which means a blood or urine result can support a case with nothing found in your pocket.

No cannabis brand is legally sold inside Wyoming, so any honest recommendation is about categories and paperwork rather than logos. What a Wyoming shelf can legally hold in 2026 is non-intoxicating hemp: broad-spectrum and isolate CBD tinctures, CBD or CBG capsules, topicals, and pet drops. The test of a good one is the certificate of analysis - a current batch report, from a third-party lab, showing delta-9 THC under 0.3 percent and no delta-8, delta-10, HHC or THC-O, all of which became controlled substances here on July 1, 2024. Anything advertised as high-potency hemp flower, THCA bud or a 25 mg hemp gummy is either mislabeled or illegal in this state. Verified cannabis brands exist across the Colorado and Montana lines, and their products are lawful only where they are sold.

Three things defined the 2025-2026 stretch here. A federal appeals court upheld Wyoming's intoxicating hemp ban in October 2025, ending the industry's best shot at reopening delta-8 sales. Congress then rewrote the federal hemp definition in November 2025, and after a September 2, 2026 stopgap most of those restrictions - a total-THC standard and a 0.4 mg per container cap - land December 11, 2026, while cannabinoids the plant cannot make lose hemp status a month earlier. And in July 2026 Wyoming declined to follow the federal move of medical cannabis to Schedule III, which keeps every product Schedule I under state law regardless of what the DEA does next.
