Texas • CONSUMPTION LOUNGES
A low-THC medical program, no adult-use market, no lounge category, and a hemp sector that lost two large categories in 2026
Texas has never had a consumption venue framework, and 2026 moved the ground under the thing people used instead. The smokable-hemp rule effective March 31, 2026 barred THCA flower, and delta-8, delta-10 and THCP were reclassified as Schedule I effective July 31, 2026. What remains is the Compassionate Use Program for registered patients and hemp-derived delta-9 products at or below the 0.3 percent standard for adults 21 and over.
Four categories get called a lounge in Texas, and none of them holds a cannabis consumption license.
Licensed dispensing organizations serve Compassionate Use Program patients, including by delivery, which is unusual for a low-THC program. They dispense only. There is no consumption area and no hospitality endorsement.
Products at or below 0.3 percent THC by dry weight remain lawful for adults 21 and older and are widely sold. Retail sale is what the framework allows. Consumption on the premises is not part of it.
Venues serving hemp-derived drinks operate under hemp law, not a cannabis framework. The reclassification of delta-8, delta-10 and THCP in July 2026 removed a large part of what many of these venues previously served.
Texas recognizes no private-club exemption for cannabis. Membership does not create a lawful consumption venue, and marijuana possession remains a criminal matter statewide.
New Mexico has adult-use retail immediately west and Colorado has an established lounge scene. Anything bought there is unlawful the moment it crosses into Texas.
Austin and Dallas generate a lot of lounge listings that are hemp venues operating under rules that changed twice this year.
A tightly limited medical program and a hemp market that is substantially smaller than it was in 2025.
No lounge fees exist. These are the Texas numbers that matter.
Does Texas have cannabis lounges?
No. The Compassionate Use Program licenses dispensing organizations only, and there is no adult-use framework to build a consumption venue on.
What about the hemp bars in Austin and Dallas?
They operate under hemp law rather than the cannabis program. The July 31, 2026 reclassification of delta-8, delta-10 and THCP removed a large part of what many of them used to serve.
Is delta-8 still legal in Texas?
No. Delta-8, delta-10 and THCP were reclassified as Schedule I effective July 31, 2026. That is a criminal-law change rather than a retail restriction.
What happened to THCA flower?
It is barred by the smokable-hemp rule effective March 31, 2026, which is a separate change from the July scheduling action.
What is still lawful on the hemp side?
Hemp-derived delta-9 products at or below 0.3 percent THC by dry weight, for adults 21 and older. That is a much narrower shelf than Texas had in 2025.
Where can a Compassionate Use patient consume?
On private property where the owner permits it. The program provides low-THC product and delivery, not a place to use it.
Do local decriminalization votes change anything?
Some Texas cities have reduced local enforcement priorities for small amounts. That affects local charging practice and does not legalize possession or authorize a lounge.
Where is the nearest licensed lounge?
Colorado has the nearest established scene, and New Mexico has adult-use retail without lounges. Everything bought in either state stays there.
