Legal to possess since 2021, legal to grow at home, and still no store and no lounge
Virginia is the longest-running gap between legalization and retail in the country. Adults have been able to possess and grow cannabis since July 1, 2021, and there has never been an adult-use store to buy it from. That changed on paper in 2026: budget bill HB 30, signed June 30, 2026, enacted a retail framework with sales expected around July 1, 2027, plus a microbusiness direct-to-consumer track that may begin no sooner than November 1, 2026. None of that includes a consumption venue license.
An unusual mix: legal possession, legal home growing, a medical market, and no adult-use retail at all.
Virginia dispenses medical cannabis through registered pharmaceutical processors and their dispensing facilities. Patients need a written certification rather than a state card, and HB 391 in 2026 expanded delivery. Consumption on the premises is not permitted.
Retail was enacted through budget bill HB 30, signed June 30, 2026, with sales expected around July 1, 2027. Until then there is no lawful adult-use store anywhere in Virginia.
Adults may grow up to four plants per household, which has been the main lawful supply route for five years. Plants must be labeled and kept out of public view.
The gap between legalization and retail produced a grey market of gifting schemes and pop-ups. Virginia has legislated repeatedly against these, and they are not a lawful way to buy or consume.
Virginia recognizes no consumption venue or private-club license. Membership does not create one, and public consumption remains prohibited.
Virginia produces more misleading cannabis listings than almost any state, because possession is legal and retail is not.

No lounge fees, and for now no adult-use retail prices either.
Does Virginia have cannabis lounges?
No. There is no consumption venue license in Virginia law, including in the retail framework enacted through HB 30 in June 2026.
Can I buy cannabis in Virginia right now?
Only as a medical patient with a written certification, from a registered pharmaceutical processor. Adult-use sales are expected around July 1, 2027.

What about gifting shops?
Not lawful. Virginia has legislated against gifting schemes repeatedly, and buying that way leaves you with an unregulated product and an unlicensed seller.
Where can I legally consume?
On private property where the owner permits it. Public consumption is prohibited and there are no licensed venues.
Can I buy in Maryland or DC instead?
You can buy there under their rules, and bringing it back into Virginia is not authorized. Crossing a state or district line with cannabis is a federal issue regardless.
Will retail bring lounges?
Not automatically. The framework enacted in 2026 covers cultivation, manufacturing, testing and retail. A consumption venue would need its own license category, which does not exist.
