Delaware started legal adult-use sales on August 1, 2025. The market is young and the stores are still mostly converted medical operators.
Delaware is a small state with a young retail market, which shows up in two ways: the store count is modest and the staff are experienced, because most of them were serving medical patients before conversion. Expect a competent, low-drama visit with a 15 percent tax on top and no delivery unless you are a registered patient.

How much can I buy?
Adults 21 and older can buy up to one ounce of flower, 12 grams of concentrate, or products containing up to 750 milligrams of delta-9 THC. Registered patients buy at a higher limit.
What is the tax?

Can I get delivery?
Only as a registered medical patient. The Marijuana Control Act bars adult-use delivery, so everyone else buys in person.
Can out-of-state visitors buy?
Yes. Any adult 21 or older with valid government photo ID can buy at an adult-use retailer, regardless of residency.
Where can I legally consume?
On private property where the owner permits it. Public consumption is prohibited and currently carries a fine of up to 200 dollars, and beach and boardwalk smoking ordinances apply on top of that.
Can I take it into Maryland or New Jersey?
No. Crossing a state line with cannabis is a federal offense, and your Delaware purchase is not authorized under another state system even when that state is also legal.
Is it worth getting a medical card?
If you buy regularly, yes. The 15 percent exemption, the higher 3 ounce per 14 day limit and delivery access usually outweigh the 50 dollar annual fee.
Delaware is an easy first visit precisely because the market is young: fewer stores, shorter menus and staff who came up on the medical side. Buy one low-potency item, take the smallest dose at home, and if you find yourself going back monthly, run the numbers on a medical registration.
