Delaware Weed Laws 2026: Adult-Use Dispensaries, the 15% Tax, and Which Towns Still Say No

Overview

Delaware legalized adult possession in April 2023 through House Bills 1 and 2, then made buyers wait more than two years for a store. Sales finally opened on August 1, 2025, and every shop that opened that day was an existing medical compassion center that had paid a six-figure conversion fee for the right to serve customers who do not hold a card. That is still essentially the market you are shopping in: the Office of the Marijuana Commissioner directory lists 14 dispensary locations run by six operators, and none of the 30 retail lottery winners picked in 2024 had opened a door as of August 2026.

The rules are unusually tight for an adult-use state. An adult 21 or older may hold an ounce of leaf marijuana; the extract ceiling is 12 grams, and infused goods are capped at 750 milligrams of delta-9 in total. Nobody may grow a plant at home, not even a registered patient. Consuming in public or inside a vehicle is illegal. Adult-use orders must be handed over on the licensed premises, so couriers only run for registered medical patients, who also skip the 15% retail marijuana tax and may buy three ounces every 14 days.

Where you live decides how far you drive. Delaware let municipalities opt out entirely, and roughly a third did, including Rehoboth Beach, Bethany Beach, Dewey Beach, Middletown and Lewes. Milford went further and banned adult-use sales in January 2025, leaving one dispensary stuck selling medical only and suing the city. Senate Bill 75, passed over Governor Matt Meyer's veto on July 1, 2026, stripped churches out of the buffer list and cut most required setbacks to 500 feet, which should finally free up storefront real estate.

The money tells the rest. Year one produced $53.4 million in sales and just over $8 million in state tax, against a first commissioner's 2023 forecast of $281 million. Enforcement against unlicensed hemp shops has picked up, with state alcohol and tobacco agents mailing roughly 70 cease-and-desist letters to dozens of businesses by spring 2026.

What People Actually Pay

Delaware is a small, supply-constrained market, so expect to pay more than you would across the line in Maryland or New Jersey. Eighths generally run $35 to $60, with premium indoor at the top of that band, and full ounces commonly land between $150 and $260. Carts sit around $35 to $60 per gram, and edible packs mostly fall between $20 and $35. The 15% retail marijuana tax is added at the register and there is no sales tax behind it, so the number on the shelf plus fifteen percent is your real total. Show a valid medical card and the tax comes off entirely.

How Access & Delivery Work

Delaware draws a hard line between the two customer types. If you are buying as an adult 21 or older without a card, state law requires the handoff to happen on the dispensary's licensed premises, which is why every store offers online ordering and in-store or curbside pickup but no courier to your door. Registered medical patients are the exception: the program specifically allows home delivery along with promotional pricing and larger purchase quantities, so several operators run patient delivery routes across New Castle, Kent and Sussex counties. Anything advertising same-day marijuana delivery to a Delaware address without checking a patient registry is operating outside the licensed system, and the state has been mailing cease-and-desist letters to unlicensed sellers since 2025. Mailing marijuana into or out of Delaware is separately illegal, and so is carrying it across the Maryland, Pennsylvania or New Jersey line.

Every gram of licensed flower on a Delaware shelf was grown inside the state, because product cannot legally cross the line in either direction. Eighths, quarters and prepackaged ounces dominate the menus, and the state cap is one ounce of leaf per adult transaction.

Vapes

Cartridges and all-in-one disposables are the fastest-moving category at most Delaware counters. They count against the 12-gram concentrate ceiling rather than the one-ounce flower limit, and every unit carries a batch number tied to the state seed-to-sale tracking system.

Singles, infused rolls and multipacks are standard at all 14 licensed locations. They are counted as flower weight, so a five-pack of half-gram joints eats into your one-ounce allowance.

Edibles

Gummies, chocolates, caramels and baked goods sell under strict packaging rules: child-resistant containers, no bright cartoon branding, and no imitation of an existing candy brand. Total delta-9 THC across the products you carry has to stay at or under 750 milligrams.

Concentrates

Live resin, rosin, badder, sugar and cartridges all fall under the same 12-gram concentrated cannabis cap. Selection is thinner than in Maryland or New Jersey because only a handful of Delaware cultivators and manufacturers were operating through 2026.

Tinctures

Sublingual oils and drops are on OMC's list of approved adult-use formats and give you dose control without inhaling anything. Patients tend to buy them more often than adult-use customers do.

Topicals

Balms, salves and lotions are sold for localized relief and are not intoxicating in normal use. They are the one category where you rarely think about the state possession math.
