Fresno is the largest city between Sacramento and Bakersfield and it was one of the last big California cities to allow a dispensary. Proposition 64 passed in 2016; Fresno did not begin approving retail licenses until 2021, and the first two stores opened in 2022 - The Artist Tree at Palm and Nees on the north side, and Embarc at Blackstone and Gettysburg on the city's main commercial spine. A tenth store opened in April 2024, about half of the 21 licenses the ordinance permits, and openings have continued since, including a second Artist Tree location in July.
The politics around the city were even slower. Fresno County bans commercial cannabis retail in its unincorporated areas, and neighboring Clovis was among the twenty-five local governments that sued the state over its statewide delivery rule - a challenge a Fresno County Superior Court judge dismissed in November 2020. That ruling is the reason a Clovis or county address can still receive a legal delivery today even though no storefront is permitted there.
Retail follows the north-south commercial arteries. Blackstone Avenue is the main one, running from downtown up past Shields, Shaw and Gettysburg, and it carries the largest share of licensed stores. The Palm and Nees area serves north Fresno and the Woodward Park side, Shaw Avenue covers the Fresno State corridor, and stores along the Kings Canyon and Ventura corridors reach southeast Fresno. Downtown and the Tower District sit between them, close enough to both that residents there have the shortest drives in the city.
California Statewide Context
California got here first and got here messily. On top of the excise you pay 7.25% state sales tax plus district add-ons, plus whatever your city charges - 10% in Los Angeles, 7% in Santa Ana, up to 5% in Oakland, 4% in Sacramento, nothing at all in San Francisco, which suspended its local cannabis tax.
Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.
Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.
