Sunny Hills Cannabis Guide: Fullerton, California

Fullerton came closer to licensed cannabis retail than almost any Orange County city and then reversed itself. In November 2020 the city council adopted an ordinance permitting up to five cannabis retail outlets. On February 16, 2021, after extended public comment, a 3-2 council vote repealed it. Chapter 15.30.030 of the municipal code still prohibits marijuana dispensaries, and that is where the matter has stood since.

What replaced retail was enforcement. The council unanimously moved to introduce an ordinance raising penalties for illegal commercial cannabis operations, with fines reaching $1,000 per violation and $10,000 per day, aligning local code with state law AB 1684. The city has been dealing with unlicensed storefronts along its commercial corridors, and the fine structure is the current answer.

Money may reopen the question. An April 2026 Voice of OC report described Fullerton grinding through a multimillion-dollar shortfall while eyeing a fall revenue measure, with cannabis money one of the options on the table. Nothing had reached a council agenda as a retail proposal by September, and the police department continues to handle unlicensed operators through the fine structure rather than a permitting path. Residents watching the issue tend to point at Santa Ana, where roughly twenty licensed shops generate local tax that Fullerton forgoes entirely. For now, a city of 140,000 with Cal State Fullerton's 40,000 students, Fullerton College and a busy downtown bar district buys entirely by delivery. Santa Ana's roughly twenty licensed stores are about twenty minutes south down Harbor Boulevard or the 57, and Stanton's licensed retail sits a similar distance southwest.

California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Since July 2021 a single agency, the Department of Cannabis Control, licenses growers, manufacturers, distributors, testing labs, retailers and delivery. The result is the biggest legal market anywhere - about 1,250 active storefront retail licenses - sitting on top of a stubborn unlicensed one that still accounts for roughly 60% of what Californians actually consume.

The tax math shifted twice in twelve months. A scheduled increase pushed the state excise tax from 15% to 19% of gross receipts on July 1, 2025. Assembly Bill 564, signed September 22, 2025, reversed it: the rate returned to 15% on October 1, 2025 and is locked there through June 30, 2028, with a review starting in the 2028-29 fiscal year. On top of the excise you pay 7.25% state sales tax plus district add-ons, plus whatever your city charges - 10% in Los Angeles, 7% in Santa Ana, up to 5% in Oakland, 4% in Sacramento, nothing at all in San Francisco, which suspended its local cannabis tax.

Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.

Two brands are impossible to miss in California: STIIIZY, which runs both a vape line and its own dispensaries from downtown Los Angeles outward, and Cookies, whose licensed flower lines and its own stores in Fresno, Hayward, Modesto and Redding helped define the modern menu. Papa & Barkley, founded in Humboldt County, is the reference point for balms and tinctures and its ratio products stock wellness shelves statewide. Beyond those, buy by farm and category: Sonoma and Humboldt sun-grown flower, solventless hash from small Emerald Triangle processors, and low-dose beverages that have taken over drink coolers since AB 8 cleared hemp seltzers out of grocery stores.

The 2026 story is a market that stopped growing and started consolidating. Licensed retailers rang up $956.7 million in the first quarter of 2026, down from $976.5 million a year earlier, while the Unified Cannabis Enforcement Task Force has destroyed more than 317 tons of illegal cannabis since 2022. AB 8 closed the intoxicating-hemp channel that vape stores had been running, and AB 1775 lounges are opening a hospitality lane in the cities that opted in. Expect more single-store closures, more delivery-only licenses, and more cities revisiting retail bans as budget gaps widen.
