Desert Hot Springs Cannabis Guide: Palm Springs, California

Palm Springs is a resort town of roughly 45,000 people that treats cannabis as part of its hospitality economy rather than a zoning nuisance. It permitted on-site consumption lounges years before the state authorized cafes, and in December 2025 the city council unanimously adopted an ordinance expanding those venues to everything AB 1775 allows: preparing and selling non-cannabis food and non-alcoholic beverages, arranging outside food service, and running both ticketed and non-ticketed live events depending on venue size.

For a visitor that changes the entire trip. In most of California a hotel guest has nowhere legal to consume, since rooms ban smoking and every sidewalk, park and pool deck is public. Here, a licensed retailer at 353 South Palm Canyon Drive runs a two-story consumption lounge in a former bank building, with a dab bar and a live music and comedy calendar. A second venue in the Uptown Design District pairs a licensed retail shop and lounge with a restaurant under one roof.

Retail sits where the walking traffic is. Downtown along and just off Palm Canyon Drive carries the highest-visibility stores, the Uptown Design District covers the north end past the vintage furniture shops, and the industrial pockets along Gene Autry Trail and near the airport hold additional licensees. Across the valley, Cathedral City, Desert Hot Springs, Palm Desert, Indio and Coachella all permit retail of their own, so the Coachella Valley is one of the few parts of Southern California where nearly every city on the map has a licensed option.

California got here first and got here messily. Proposition 215 made it the first medical state in 1996, Proposition 64 passed on November 8, 2016 with about 57% of the vote, and licensed adult-use sales opened January 1, 2018. Since July 2021 a single agency, the Department of Cannabis Control, licenses growers, manufacturers, distributors, testing labs, retailers and delivery. The result is the biggest legal market anywhere - about 1,250 active storefront retail licenses - sitting on top of a stubborn unlicensed one that still accounts for roughly 60% of what Californians actually consume.

The tax math shifted twice in twelve months. A scheduled increase pushed the state excise tax from 15% to 19% of gross receipts on July 1, 2025. Assembly Bill 564, signed September 22, 2025, reversed it: the rate returned to 15% on October 1, 2025 and is locked there through June 30, 2028, with a review starting in the 2028-29 fiscal year. On top of the excise you pay 7.25% state sales tax plus district add-ons, plus whatever your city charges - 10% in Los Angeles, 7% in Santa Ana, up to 5% in Oakland, 4% in Sacramento, nothing at all in San Francisco, which suspended its local cannabis tax.

Access is a map problem, not a legality problem. The Department of Cannabis Control counts roughly 56% of California cities and counties as not allowing retail. Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 has separately barred locals from blocking medicinal deliveries since January 1, 2024.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and banned hemp flower, hemp pre-rolls, inhalable hemp-THC products and synthetic cannabinoids like delta-8 and HHC from sale by anyone in California - smoke shops and licensed dispensaries alike - under Business and Professions Code section 26070.2. And AB 1775 cafes are arriving: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's cafe ordinance took effect in August 2026 with permit applications opening that October, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.

Two brands are impossible to miss in California: STIIIZY, which runs both a vape line and its own dispensaries from downtown Los Angeles outward, and Cookies, whose licensed flower lines and its own stores in Fresno, Hayward, Modesto and Redding helped define the modern menu. Papa & Barkley, founded in Humboldt County, is the reference point for balms and tinctures and its ratio products stock wellness shelves statewide. Beyond those, buy by farm and category: Sonoma and Humboldt sun-grown flower, solventless hash from small Emerald Triangle processors, and low-dose beverages that have taken over drink coolers since AB 8 cleared hemp seltzers out of grocery stores.

The 2026 story is a market that stopped growing and started consolidating. Licensed retailers rang up $956.7 million in the first quarter of 2026, down from $976.5 million a year earlier, while the Unified Cannabis Enforcement Task Force has destroyed more than 317 tons of illegal cannabis since 2022. AB 8 closed the intoxicating-hemp channel that vape stores had been running, and AB 1775 lounges are opening a hospitality lane in the cities that opted in. Expect more single-store closures, more delivery-only licenses, and more cities revisiting retail bans as budget gaps widen.
