Delivery is what fills those holes: state rule 16 CCR 5416(d) lets a licensed retailer deliver into any jurisdiction in California, a Fresno County judge dismissed the 25-jurisdiction challenge to that rule in November 2020, and Senate Bill 1186 separately bars locals from blocking medicinal deliveries.

Two 2026 changes matter at the counter. AB 8 took effect January 1, 2026 and pulled smokable hemp, hemp pre-rolls and synthetic cannabinoids like delta-8 and HHC out of gas stations and vape shops - intoxicating product now belongs to licensed dispensaries. And AB 1775 cafes are finally real: Palm Springs adopted its lounge ordinance in December 2025, San Francisco's took effect August 23, 2026, and Sacramento is phasing in a pilot of up to 40 in-dispensary lounges.
