Dover is the only city in Delaware where you can drive past the agency that licenses dispensaries, the legislature that legalized them, and a store selling the product, all inside fifteen minutes. The Office of the Marijuana Commissioner works out of 1128 South Bradford Street, a few blocks from Legislative Hall, where House Bills 1 and 2 cleared in April 2023. That proximity does not translate into more stores - the capital has exactly one.

That store is Best Buds, operated by CT Delaware on Jefferic Boulevard just off North DuPont Highway. It is minority and veteran owned, runs as a UFCW union shop, and serves both adult-use customers with photo ID and registered patients, who skip the 15% tax at the register. If it is closed or picked over, The Farm in Felton is about fifteen minutes south on Route 13 and has the state's only drive-thru, while Ayr in Smyrna is a similar run north.

For anyone operating retail here, the corridor that matters is North DuPont Highway between Scarborough Road and the Dover Mall, plus the Jefferic and Bay Court commercial pockets feeding off it. South DuPont Highway toward the Route 1 interchange is the other stretch with the parcel sizes and zoning depth that a marijuana retailer needs. Delaware Statewide Context

Delaware legalized adult possession in April 2023 through House Bills 1 and 2, then made buyers wait more than two years for a store. An adult 21 or older may hold an ounce of leaf marijuana; the extract ceiling is 12 grams, and infused goods are capped at 750 milligrams of delta-9 in total. Nobody may grow a plant at home, not even a registered patient. Consuming in public or inside a vehicle is illegal. Adult-use orders must be handed over on the licensed premises, so couriers only run for registered medical patients, who also skip the 15% retail marijuana tax and may buy three ounces every 14 days.

Where you live decides how far you drive. Delaware let municipalities opt out entirely, and roughly a third did, including Rehoboth Beach, Bethany Beach, Dewey Beach, Middletown and Lewes. Milford went further and banned adult-use sales in January 2025, leaving one dispensary stuck selling medical only and suing the city. Senate Bill 75, passed over Governor Matt Meyer's veto on July 1, 2026, stripped churches out of the buffer list and cut most required setbacks to 500 feet, which should finally free up storefront real estate.

The money tells the rest. Year one produced $53.4 million in sales and just over $8 million in state tax, against a first commissioner's 2023 forecast of $281 million. Enforcement against unlicensed hemp shops has picked up, with state alcohol and tobacco agents mailing roughly 70 cease-and-desist letters to dozens of businesses by spring 2026.
