The Mispillion River splits Milford between Kent and Sussex counties, and for most of the city's history that line was a curiosity. In cannabis it turned out to matter, because Milford chose to govern this differently from its neighbors. On January 13, 2025, city council voted to prohibit recreational marijuana sales inside city limits, a decision Mayor Todd Culotta has defended as the council's call to make even though the vote was not unanimous.

That ordinance created the strangest retail situation in Delaware. Fresh Cannabis has operated a medical dispensary here since summer 2024 and was awarded a state adult-use retail license on October 29, 2024, months before the ban passed. It paid $100,000 for a license it cannot use, and the company sued the city over it. As of the 2026 legislative session, Milford remained the only Delaware city where a licensed store sells to patients and turns away everyone else, and the state's marijuana commissioner told council in March 2026 that the store earns roughly a tenth of what the company's adult-use locations do.

For operators, the geography is worth studying. The DuPont Boulevard frontage on Route 113 and the Route 1 commercial belt near the Bayhealth Sussex campus are the corridors with the parcels, but both sit inside the city's prohibition. The unincorporated stretches north toward Lincoln and Houston, outside the municipal line, are where a Senate Bill 75 buffer of 500 feet actually leaves room to build.

Delaware Statewide Context

Delaware legalized adult possession in April 2023 through House Bills 1 and 2, then made buyers wait more than two years for a store. Sales finally opened on August 1, 2025, and every shop that opened that day was an existing medical compassion center that had paid a six-figure conversion fee for the right to serve customers who do not hold a card. Where you live decides how far you drive. Delaware let municipalities opt out entirely, and roughly a third did, including Rehoboth Beach, Bethany Beach, Dewey Beach, Middletown and Lewes. Milford went further and banned adult-use sales in January 2025, leaving one dispensary stuck selling medical only and suing the city. Senate Bill 75, passed over Governor Matt Meyer's veto on July 1, 2026, stripped churches out of the buffer list and cut most required setbacks to 500 feet, which should finally free up storefront real estate.

The money tells the rest. Year one produced $53.4 million in sales and just over $8 million in state tax, against a first commissioner's 2023 forecast of $281 million. Enforcement against unlicensed hemp shops has picked up, with state alcohol and tobacco agents mailing roughly 70 warning notices across more than 60 businesses by spring 2026.
