Southeast Boise Cannabis Guide: Boise, Idaho

The Idaho Statehouse sits eight blocks from the Grove Plaza, and the legislature that meets inside it has spent every recent session moving away from cannabis rather than toward it. That matters more in Boise than anywhere else in the state, because policy written on Jefferson Street applies to a metro that has added tens of thousands of transplants from Washington, Oregon, California and Colorado, most of whom arrive assuming a city this size has a shop somewhere. It does not, and it has never had one.

The practical result is a commuting pattern rather than a retail market. Boise State students, downtown office workers and Micron engineers all run the same errand west on I-84 through Caldwell and across the Snake River, then turn around and come back empty because the return trip is where the criminal exposure lives. Idaho State Police work that corridor deliberately, and an eastbound stop near Fruitland or the Payette County line is the classic way a legal Oregon purchase becomes an Idaho misdemeanor with a $300 floor.

What Boise actually has is a hemp and smoke-shop trade strung along its arterials: Fairview Avenue between Cole and Milwaukee, State Street through Collister, Overland Road near Orchard, and Broadway Avenue below the Boise State campus. Those storefronts sell zero-THC CBD, glass, vaporizer hardware and kratom, and they operate under a state rule that caps retail hemp at 0.0% THC rather than the 0.3% every neighboring state uses. For a shop owner on one of those blocks, that distinction is the entire business model.

Idaho is one of three states, alongside Kansas and South Carolina, that reached mid-2026 with no cannabis program of any kind. There is no adult-use statute, no patient registry, no city that can decriminalize on its own, and no licensed storefront inside the state line. Marijuana sits in Title 37, Chapter 27 of Idaho Code with the rest of the controlled substances, and interdiction on I-84, I-90 and US-95 is a standing part of highway policing.

Penalties got heavier in 2025, not lighter. House Bill 7 took effect July 1, 2025 and attached a mandatory minimum $300 fine to possession of three ounces or less for anyone 18 or older, on top of a misdemeanor that already carried up to a year in jail and a $1,000 ceiling. Above three ounces the charge becomes a felony punishable by up to five years and $10,000. A pound of product, or 25 plants, moves a case into trafficking with mandatory prison time attached.

The hemp shelf is not a workaround. Idaho requires retail hemp products to test at 0.0% THC, and legal CBD has to come from five specific parts of the plant listed in Idaho Code 37-2701. That rules out delta-8, hemp-derived delta-9 gummies and seltzers, THCA flower, and ordinary full-spectrum oil that any other Western state sells freely. House Bill 879, signed in April 2026 and effective July 1, 2026, pulled consumable and inhalable hemp retail formally under the state hemp act.

So Idahoans drive. Ontario sits just over the Snake River in Oregon and moves better than $100 million a year, with city officials estimating roughly 90% of buyers arrive from this side. Jackpot in Nevada, Clarkston and Spokane Valley in Washington, and West Yellowstone in Montana cover the other corners. Every one of those sales is lawful where it happens and unlawful the second it re-enters Idaho.

No cannabis brand is legally sold in Idaho, so there is nothing honest to recommend inside the state line. What exists is verified retail across four borders. In Ontario, Oregon, roughly a dozen licensed shops operate, among them Burnt River Farms, Weedology, Treasure Valley Cannabis Company and Hotbox Farms. Thrive Cannabis Marketplace runs a drive-thru store at 1868 Royal Drive in Jackpot, Nevada. Canna4Life, Sativa Sisters and Greenfield Company serve the Lewiston-Clarkston valley from the Washington side. Primo Cannabis, Cinder and Cannabis and Glass cover the Spokane Valley and Liberty Lake approaches to north Idaho. Lone Peak Caregivers, Yellowstoned and Northstar Evolution sit on Targhee Pass Highway in West Yellowstone, Montana. Every one of those purchases is legal there and illegal here.

Two things define the 2026 cycle. First, the Idaho Medical Cannabis Act died at the signature stage: Secretary of State Phil McGrane announced on July 14, 2026 that the campaign came in around 58,024 valid signatures against a 70,725 threshold, and qualified in 13 legislative districts instead of the required 18. Second, HJR 4 goes to voters on November 3, 2026, and would amend the constitution to give the legislature sole authority over legalizing marijuana and other psychoactive substances, closing the initiative route for good. Meanwhile hemp retail tightened again under House Bill 879 in July 2026.
