Overview

Idaho is one of three states, alongside Kansas and South Carolina, that reached mid-2026 with no cannabis program of any kind. There is no adult-use statute, no patient registry, no city that can decriminalize on its own, and no licensed storefront inside the state line. Marijuana sits in Title 37, Chapter 27 of Idaho Code with the rest of the controlled substances, and interdiction on I-84, I-90 and US-95 is a standing part of highway policing.

Penalties got heavier in 2025, not lighter. House Bill 7 took effect July 1, 2025 and attached a mandatory minimum $300 fine to possession of three ounces or less for anyone 18 or older, on top of a misdemeanor that already carried up to a year in jail and a $1,000 ceiling. Above three ounces the charge becomes a felony punishable by up to five years and $10,000. A pound of product, or 25 plants, moves a case into trafficking with mandatory prison time attached.

The hemp shelf is not a workaround. Idaho requires retail hemp products to test at 0.0% THC, and legal CBD has to come from five specific parts of the plant listed in Idaho Code 37-2701. That rules out delta-8, hemp-derived delta-9 gummies and seltzers, THCA flower, and ordinary full-spectrum oil that any other Western state sells freely. House Bill 879, signed in April 2026 and effective July 1, 2026, pulled consumable and inhalable hemp retail formally under the state hemp act.

So Idahoans drive. Ontario sits just over the Snake River in Oregon and moves better than $100 million a year, with city officials estimating roughly 90% of buyers arrive from this side. Jackpot in Nevada, Clarkston and Spokane Valley in Washington, and West Yellowstone in Montana cover the other corners. Every one of those sales is lawful where it happens and unlawful the second it re-enters Idaho.

What People Actually Pay

Idaho has no legal price to quote, so the numbers that matter are border numbers. Oregon runs the cheapest regulated market in the country: expect eighths around $15-$35 and ounces near $60-$140 in Ontario, plus 17% state tax and the local 3% the city collects. Washington bakes a 37% excise into the sticker, which pushes Clarkston and Spokane Valley eighths toward $20-$45. Nevada adds a 10% retail excise on top of sales tax, and Jackpot's isolation keeps eighths closer to $25-$50. Montana charges 20% on adult-use, landing West Yellowstone eighths around $20-$40. Idaho's own price is the $300 fine.

How Access & Delivery Work

There is no lawful marijuana delivery in Idaho, and there is no route to one, because there is no licensed retail tier for a courier to work from. Anything advertising same-day drop-offs to a Boise or Coeur d'Alene address is an unlicensed seller, and both the buyer and the courier are exposed: possession is a misdemeanor with a mandatory $300 floor, and the person handing it over faces a distribution charge. Oregon, Washington and Nevada all license delivery inside their own borders, but every one of those programs stops at the state line by rule as well as by federal law. Mail-order hemp THC also fails here, since Idaho holds retail hemp to 0.0% THC.

There is no lawful pre-roll market. A single joint is charged the same way as loose flower, which means the $300 mandatory minimum applies to a quantity most legal states would not bother weighing.

Edibles

Marijuana edibles are illegal, and so are the hemp-derived gummies and THC seltzers that fill convenience-store coolers in neighboring states, because Idaho's retail hemp threshold is 0.0% THC rather than the federal 0.3%.

Concentrates

Wax, shatter, live resin and rosin are prosecuted under the same marijuana statute, and because concentrate weight is small relative to potency, a modest stash can still be measured against the three-ounce felony line.

Tinctures

THC tinctures are illegal. Zero-THC CBD tinctures can be sold if the material comes from the five plant parts named in Idaho Code 37-2701 and lab work shows no detectable THC after decarboxylation.

Topicals

THC balms and salves are prohibited. CBD topicals are the one category with a real Idaho retail presence, and only when a certificate of analysis backs a 0.0% THC result for that specific batch.

Current Trends (2026)

Two things define the 2026 cycle. First, the Idaho Medical Cannabis Act died at the signature stage: Secretary of State Phil McGrane announced on July 14, 2026 that the campaign came in around 58,024 valid signatures against a 70,725 threshold, and qualified in 13 legislative districts instead of the required 18. Second, HJR 4 goes to voters on November 3, 2026, and would amend the constitution to give the legislature sole authority over legalizing marijuana and other psychoactive substances, closing the initiative route for good. Meanwhile hemp retail tightened again under House Bill 879 in July 2026.
