Overview
Illinois became the 11th state to legalize recreational cannabis when Governor J.B. Pritzker signed the Cannabis Regulation and Tax Act on June 25, 2019. Recreational sales began January 1, 2020, making Illinois the first state to legalize through legislative action rather than a ballot initiative.
As of January 2026, Illinois has approximately 200+ licensed cannabis dispensaries serving both medical patients and adult-use customers. Over 500,000 cannabis-related convictions have been expunged since legalization.
Adults 21+ can possess up to 30 grams of cannabis flower, 5 grams of concentrate, and 500mg THC in edibles. Out-of-state visitors can possess HALF these amounts: 15g flower, 2.5g concentrate, 250mg THC edibles. Home cultivation is restricted to medical patients only (5 plants).
Illinois has one of the highest cannabis tax rates in the nation, with total taxes ranging from 25-35% depending on product type and location.

How Access & Delivery Work
Cannabis delivery is NOT currently legal in Illinois as of January 2026. House Bill 2557 (Cannabis Delivery License Act) was introduced but hasn't passed. All cannabis purchases must be made in-person at licensed dispensaries. Many dispensaries offer online pre-ordering for faster in-store pickup.
