Kansas is one of the last states in the country with no legal marijuana of any kind. Possession is prosecuted under K.S.A. 21-5706: a first conviction is a class B nonperson misdemeanor with up to six months in jail and a fine up to $1,000, a second is a class A nonperson misdemeanor, and a third pushes into drug severity level 5 felony territory.
The narrow exception is cannabidiol. Senate Bill 282, signed in May 2018, pulled CBD out of the state controlled substances definition, and Claire and Lola's Law followed in 2019, defining a cannabidiol treatment preparation at K.S.A. 65-6235 as one testing no more than 5% THC relative to CBD and writing the matching affirmative defense into K.S.A. 21-5706(d). That defense requires a letter from a Kansas-licensed physician, dated within the prior 15 months, naming a debilitating condition. It is a courtroom defense, not a card, and it buys you nothing at a checkout counter.
Hemp is where the real Kansas retail market lives, and it is contested. Attorney General Kris Kobach and Kansas Bureau of Investigation director Tony Mattivi opened a statewide enforcement operation on October 1, 2025, raiding ten storefronts in six cities the first day and serving at least 15 search warrants overall. How Access & Delivery Work
There is no legal cannabis delivery in Kansas. No service holds a license because Kansas issues none, so any app, text-message menu or social account promising same-day weed here is an illegal operation, and both sides of that transaction are exposed.
Missouri dispensaries can deliver, but only inside Missouri. Crossing the state line with product from a Missouri or Colorado store is a Kansas possession charge the moment the wheels touch Kansas pavement, and it is a federal offense on top of that.
What does move by mail is hemp: CBD and hemp THC products ship to Kansas addresses from out-of-state sellers, and some Kansas shops run their own local drop-offs. That flow is legal only as far as the product stays under the hemp threshold and in a format Kansas permits, which is exactly the line the 2025 raids tested.

- Vapes
Marijuana carts are illegal, and so are hemp ones: K.S.A. 2-3908(a)(1)(E) bars selling liquids, solids or gases containing industrial hemp for use in vaporizing devices, so wax, rosin and dab pens are covered right along with cartridges. Kansas also defines THC concentration under K.S.A. 65-6235(b)(3) as the combined percentage of tetrahydrocannabinol and its acids reported as free THC, a total-THC test a delta-8 or THCa cart almost never passes, which makes it not a hemp product at all and puts the THC in it in Schedule I today, independent of the federal change on November 12, 2026. Because 2-3908 makes the sale unlawful, the hemp-product exception in K.S.A. 65-4105(h)(1)(C) falls away, so possession is a separate criminal question for the buyer under K.S.A. 21-5706 and not only a seller problem. Selling is a class A nonperson misdemeanor on a first conviction and a severity level 9 nonperson felony after that.

There is no legal marijuana pre-roll sold anywhere in Kansas, and K.S.A. 2-3908(a)(1)(A) and (B) ban the sale of hemp cigarettes and cigars in the same breath. Once a product is unlawful under that section, Schedule I stops excepting it: the carve-out at K.S.A. 65-4105(h)(1)(C) applies only "unless otherwise deemed unlawful pursuant to K.S.A. 2-3908," so the THC in a hemp joint is a controlled substance and the person carrying it faces a possession question under K.S.A. 21-5706, quite apart from what the store did. Penalties for the sale run from a class A nonperson misdemeanor up to a severity level 9 nonperson felony on repeat convictions. Hemp-derived gummies, chocolates and chews are the most common THC products on Kansas shelves, legal precisely because they are made for oral use. Kansas sets no milligram cap, only a 0.3% total-THC ceiling by weight, and the federal 0.4 milligram-per-container limit reaches most products December 11, 2026.
- Concentrates
