That defense requires a letter from a Kansas-licensed physician, dated within the prior 15 months, naming a debilitating condition. It is a courtroom defense, not a card, and it buys you nothing at a checkout counter.
Hemp is where the real Kansas retail market lives, and it is contested. Attorney General Kris Kobach and Kansas Bureau of Investigation director Tony Mattivi opened a statewide enforcement operation on October 1, 2025, raiding ten storefronts in six cities the first day and serving at least 15 search warrants overall. The owner of a McPherson CBD store sued in December 2025, arguing the state was seizing federally compliant hemp goods under a vague standard, and two vape shops brought a federal Fourth Amendment case in March 2026.
