Overview
Kentucky legalized medical cannabis through Senate Bill 47, signed by Governor Andy Beshear on March 31, 2023. The program officially launched January 1, 2025, though it took until December 13, 2025 for the first dispensaryβThe Post in Beaver Damβto open its doors.
As of January 2026, Kentucky's medical cannabis program is in its early stages. The first dispensary sold out within seven days of opening, highlighting the intense demand among the state's 23,000+ registered patients. More dispensaries are expected to open throughout early 2026 as cultivation ramps up.
Kentucky requires all medical cannabis to be grown and processed in-state, which initially limited supply. Cultivators like Armory Kentucky and Farmtucky are ramping up production to meet demand. The state has licensed 48 dispensaries across the commonwealth, with one per county (except Louisville and Lexington, which each have two).
To access medical cannabis in Kentucky, patients must have a qualifying medical condition, receive a written certification from a registered practitioner (in-person visit required for initial certification), and obtain a state-issued medical cannabis card. The card costs $25 and is valid for one year.
Important restrictions: Kentucky does NOT allow smoking of raw cannabis. Patients must vaporize flower or use other approved products like edibles, tinctures, oils, and vape cartridges. Home cultivation is NOT permitted.
Recreational cannabis remains illegal in Kentucky. Only registered medical patients with valid cards can purchase from licensed dispensaries. Possession without a medical card remains a criminal offense.
The program is expected to expand significantly throughout 2026 as more dispensaries open, cultivation increases, and product variety improves.

Buying Across State Lines
Kentucky borders Illinois (recreational legal), Ohio (recreational legal), West Virginia (medical), Virginia (recreational legal), Tennessee (medical only), Missouri (recreational legal), and Indiana (not legal).
Despite being surrounded by several legal states, transporting cannabis across state lines remains a federal crime. Do NOT bring cannabis into Kentucky from neighboring states, and do NOT take Kentucky medical cannabis across state lines.
Governor Beshear's Executive Order 2022-798 previously provided some protection for patients who purchased cannabis legally in other states, but this was intended as a bridge until Kentucky's own program launched. Now that dispensaries are opening, patients should purchase from Kentucky-licensed dispensaries.
If caught with cannabis without a valid Kentucky medical card, you may face criminal charges. Kentucky's recreational cannabis laws have not changedβonly medical use is legal.
What People Actually Pay
Kentucky cannabis pricing (January 2026 - early program, subject to change):
During the initial launch at The Post Dispensary:
Flower: ~$50 per eighth (limited hybrid strain available)
Vaporizers: Required for flower consumption, sold at dispensary
Expected pricing as market develops:
Flower: $45-60 per eighth
Vapes: $50-80 for cartridges
Edibles: $20-40 per package
Tinctures: $40-70
Note: Early pricing is higher due to extremely limited supply. Prices are expected to decrease as more cultivators harvest and dispensaries open. The first dispensary sold out within 7 days, indicating supply constraints.
Medical card: $25 annual fee
Doctor certification: $100-200 (not covered by insurance)
No recreational sales tax appliesβKentucky only has medical cannabis. Standard state sales tax applies to products.
How Access & Delivery Work
Cannabis delivery is NOT legal in Kentucky. All medical cannabis must be purchased in-person at licensed dispensaries. Patients must present their valid Kentucky medical cannabis registry ID card at the dispensary.
As of January 2026, dispensary availability is still limited. The Post Dispensary in Beaver Dam was the first to open (December 13, 2025) but quickly sold out of inventory. Additional dispensaries in Louisville, Lexington, Bowling Green, and other cities are expected to open throughout early 2026.
Patients should check the Kentucky Medical Cannabis Program website (kymedcan.ky.gov) for the most current information on which dispensaries are open and have product available.
Payment is typically cash-only, though some dispensaries may accept debit cards. Credit cards are not accepted due to federal banking restrictions.
Product Guides
Kentucky allows raw cannabis flower but ONLY for vaporizationβsmoking is prohibited by law. All flower sold must be labeled "not intended for consumption by smoking." THC limits: 35% maximum for flower. Patients need a vaporizer device to legally consume flower. Early products include hybrid strains from Kentucky cultivators. Eighths expected to run $45-60 as supply stabilizes.
Vape cartridges and devices are a primary consumption method in Kentucky. THC concentrate limits: 70% maximum. Only patients 21+ can purchase vaping products. Expect cartridges from Kentucky processors as cultivation expands. Prices estimated $50-80 for cartridges once supply stabilizes.
Edibles are legal in Kentucky with a 10mg THC per serving maximum limit. Products include gummies, chocolates, and other infused items. Good option for patients who don't want to vaporize. Start with low doses (5mg) and wait 90+ minutes before taking more.
Tinctures and oils provide precise sublingual dosing. Popular among medical patients for consistent medication. Available in various THC:CBD ratios. Good for patients seeking smoke-free options with fast onset.
Concentrates available for vaporization (not dabbing in traditional sense). THC limits: 70% maximum. Includes oils and extracts from Kentucky processors.
Topical cannabis products for localized relief without psychoactive effects. Balms, lotions, and creams expected as product variety expands.
