Overview

Maine voters approved adult-use legalization in November 2016, but rulemaking disputes and a gubernatorial veto pushed the first licensed sale back to October 9, 2020. The Office of Cannabis Policy (OCP), inside the Department of Administrative and Financial Services, licenses every cultivator, manufacturer, testing lab, and retail store under Title 28-B. Unlike states run by a handful of multi-state operators, Maine's ownership rules and geography produced a market of small, independently owned cultivators and stores — and no store can open in a town unless that town has voted to opt in, which plenty still haven't.

A purchase works the same way almost everywhere: government-issued photo ID, up to 2.5 ounces of cannabis (or 2.5 ounces combined with no more than 10 grams of concentrate), and flower that's usually grown outdoors or in unheated greenhouses rather than sealed indoor warehouses, since Maine's climate and small-grower economics favor sun-grown cultivation. Adults 21+ may also grow their own — up to 6 mature plants, 12 immature plants, and unlimited seedlings per person — without a medical card.

Taxes changed heading into this year: the cannabis-specific sales tax that applies in place of Maine's standard 5.5% rate rose from 10% to 14% on January 1, 2026 under a state budget law (PL 2025, c. 388), so a $40 pre-tax purchase now costs closer to $45.60 than the $44 it would have in 2025. Cultivators also pay a wholesale excise tax baked into price before a product reaches a shelf — $223 per pound of flower, $63 per pound of trim, $1 per immature plant — which shoppers never see itemized but which shapes what a $30 eighth costs to grow.

Licensed delivery is legal statewide, and a municipality can't block an incoming delivery even if it hasn't opted in to host a store of its own — a real factor in Maine's many small towns with no dispensary nearby. Maine licenses no consumption lounges; use is legal only in a private home or with an owner's permission. Maine's older medical program, created in 1999, continues to serve registered patients outside the adult-use tax rate.

Expect eighths of flower in the mid-$20s to mid-$40s before tax, with top-shelf small-batch runs pushing past $50 in some Portland-area stores. Vape carts generally run $30-55, edibles packages $15-30, and solventless concentrates $40-70 per gram depending on extraction method. The 14% cannabis sales tax that took effect January 1, 2026 adds noticeably more to a receipt than the old 10% rate did — a $35 eighth now costs about $39.90 rather than $38.50 — so factor that in before comparing a sticker price to what you'll actually pay at the register.

How Access & Delivery Work

Any licensed cannabis store, cultivation facility, or products manufacturing facility can run a "limited delivery service" under Title 28-B, and state law is unusually protective of it: a municipality cannot prohibit delivery of adult-use cannabis into its borders even if that town has never voted to allow a retail store of its own. That makes delivery the practical option for a lot of rural Maine, where the nearest licensed shop can be a 30-to-60-minute drive.
Drivers must be trained to check that the recipient is 21 or older with valid photo ID at hand-off — no leaving a package at the door. Delivery is barred from safe zones a municipality designates near schools, and a driver can deliver to a hotel or business only with the location's written consent on file with the licensee. Curbside pickup outside a store is also expressly legal under the same 2023 law changes that formalized delivery.

Non-intoxicating balms and lotions for muscle and joint relief sit on most shelves; potency isn't capped the way ingestible products are, so check the milligram label rather than assuming a standard strength.

Beverages

Low-dose (2-10mg) THC drinks are the fastest-growing new product line in Maine stores heading into 2026, marketed as a lower-commitment alternative to a full edible or a flower session.
