York Cannabis Guide: Kittery, Maine

Kittery holds the distinction of Maine's oldest incorporated town, chartered in 1647, and today it's best known as the state's southern gateway — the first exit off I-95 after crossing the Piscataqua River from New Hampshire, and home to the sprawling Kittery Outlets that draw shoppers from both states. The Portsmouth Naval Shipyard, despite its name, actually sits on Seavey's Island within Kittery's town line, and its workforce of submarine builders and repair technicians shapes the local economy as much as tourism does.

Buying cannabis here works the same as anywhere else in the state: show a valid photo ID proving you're 21 or older, stay under the 2.5-ounce cap, and expect Maine's 14% cannabis sales tax, effective since January 1, 2026. Kittery's position matters here in one specific way that most Maine towns don't have to think about: New Hampshire, directly across the Memorial and Sarah Mildred Long bridges, has no legal recreational cannabis market, so anything bought in Kittery has to stay in Maine — carrying it across the bridge is a separate legal risk on top of any federal crossing issue.

Retail concentrates near Wallingford Square, the town's historic center, and along the Route 1 corridor closer to the outlet malls. A store visible in either area picks up both local Kittery traffic and the steady flow of New Hampshire and Massachusetts shoppers already in town for the outlets, who can legally buy here even though they can't take it home.

Maine voters approved adult-use legalization in November 2016, but rulemaking disputes and a gubernatorial veto pushed the first licensed sale back to October 9, 2020. The Office of Cannabis Policy (OCP), inside the Department of Administrative and Financial Services, licenses every cultivator, manufacturer, testing lab, and retail store under Title 28-B. Unlike states run by a handful of multi-state operators, Maine's ownership rules and geography produced a market of small, independently owned cultivators and stores — and no store can open in a town unless that town has voted to opt in, which plenty still haven't.

A purchase works the same way almost everywhere: government-issued photo ID, up to 2.5 ounces of cannabis (or 2.5 ounces combined with no more than 10 grams of concentrate), and flower that's usually grown outdoors or in unheated greenhouses rather than sealed indoor warehouses, since Maine's climate and small-grower economics favor sun-grown cultivation. Adults 21+ may also grow their own — up to 6 mature plants, 12 immature plants, and unlimited seedlings per person — without a medical card.

Taxes changed heading into this year: the cannabis-specific sales tax that applies in place of Maine's standard 5.5% rate rose from 10% to 14% on January 1, 2026 under a state budget law (PL 2025, c. 388), so a $40 pre-tax purchase now costs closer to $45.60 than the $44 it would have in 2025. Cultivators also pay a wholesale excise tax baked into price before a product reaches a shelf — $223 per pound of flower, $63 per pound of trim, $1 per immature plant — which shoppers never see itemized but which shapes what a $30 eighth costs to grow.

Licensed delivery is legal statewide, and a municipality can't block an incoming delivery even if it hasn't opted in to host a store of its own — a real factor in Maine's many small towns with no dispensary nearby. Maine licenses no consumption lounges; use is legal only in a private home or with an owner's permission. Maine's older medical program, created in 1999, continues to serve registered patients outside the adult-use tax rate.

Maine's adult-use market is built on small, independently owned cultivators and processors rather than the multi-state edible and vape companies that dominate shelves in bigger legal states, so a specific national label showing up consistently store to store isn't the norm here the way it is in Massachusetts or Illinois. What's worth shopping for by category instead: outdoor or greenhouse-grown single-strain flower with a visible harvest date, solventless live rosin from a Maine extraction licensee, and infused pre-rolls made from a store's own flower rather than trim. Ask the counter staff which local cultivator is running that week's best batch — in a market this fragmented, the person behind the counter usually knows more than any label does, and checking a product's OCP-issued test results for potency and contaminants matters more here than brand recognition.

Solventless rosin continues gaining shelf space over cheaper distillate-based concentrates as Maine's small processors lean into quality over volume. Low-dose THC beverages are the fastest-growing new category statewide heading into 2026. The January 1, 2026 jump from a 10% to 14% cannabis sales tax is the single biggest change shoppers will notice this year, and licensed delivery keeps expanding into rural towns that have never voted to host a retail store of their own.
