Downtown Cannabis Guide: Fargo, North Dakota

Fargo carries roughly a quarter of North Dakota's population growth on its own, and the split personality of this market shows up on a map: the state line runs down the middle of the Red River, four miles from downtown Broadway, and the law changes completely when you cross it. North Dakota State University adds close to 12,000 students to a city that already anchors the region for health care, freight and tech jobs, and a lot of those students arrive from Minnesota assuming the rules travel with them. They do not.

On the Fargo side, the only legal cannabis purchase is medical. Pure Dakota Health holds the license here, and you need a Division of Medical Marijuana card in hand plus a government photo ID before anyone rings you up. Nothing is delivered. Nothing is grown at home. A registered caregiver can make the run for you, but there is no app, no courier and no curbside handoff anywhere in Cass County.

The retail geography is simple once you know it. The dispensary sits in the 13th Avenue South corridor between 42nd and 45th Streets, the same strip that runs past West Acres, so the trip doubles as a normal errand for most of south Fargo. CBD and wellness storefronts cluster along 13th Avenue South, Main Avenue and University Drive downtown, and those shops are limited by state hemp law to CBD and CBG goods, tinctures and topicals rather than the gummies and drinks sold five minutes east in Moorhead. Broadway and NP Avenue carry the head shop and glass trade downtown.

North Dakota has been a medical-only state since voters approved the Compassionate Care Act as Initiated Measure 5 in 2016. The first dispensary sales did not happen until March 2019, and the program is run by the Division of Medical Marijuana inside the Department of Health and Human Services, based at 600 East Boulevard Avenue in Bismarck. The state counted 10,317 cards issued as of August 6, 2026.

Retail here is deliberately small. State law caps the market at eight dispensing compassion centers and two manufacturing facilities, and every one of those eight storefronts is currently held by Curaleaf, Pure Dakota Health or Strive Life. Nothing is delivered, nothing is grown at home, and a patient card only protects product bought inside North Dakota from one of those eight counters. Purchases carry the ordinary 5 percent state sales tax plus city and county sales tax; there is no cannabis excise tax on top.

August 1, 2025 brought the biggest expansion the program has had. House Bill 1203 and Senate Bill 2294 added cannabinoid edibles in the form of square hard or soft lozenges capped at 5 mg of THC per serving and 50 mg per package, dropped the in-person requirement for a first certification visit so telehealth now counts, stretched patient cards from one year to two, and raised the application fee to $40. Senate Bill 2293 capped concentrate containers at one gram. Nonresidents can now get a 60-day North Dakota card.

Politically the state has narrowed but not moved. Measure 5 lost 52.55 to 47.45 percent in November 2024, the third defeat in six years. Meanwhile Minnesota opened licensed adult-use retail in September 2025 and Montana has sold adult-use since 2022, which leaves North Dakota ringed by legal stores it gives its own residents no legal way to use.

The whole state runs on three licensed operators, so there is no long brand shelf to compare. Curaleaf holds the dispensaries in Minot, Dickinson, Jamestown and Devils Lake. Pure Dakota Health holds Bismarck, Fargo and Williston. Strive Life holds Grand Forks. Products come from the two licensed manufacturing facilities, which is why the same strain names and cartridge hardware turn up in stores hundreds of miles apart. Outside the program, the only cannabinoid goods legally sold at ordinary North Dakota retail are CBD and CBG items, hemp tinctures under 30 mL and hemp topicals under 50 mg total THC per container. Delta-8, THC-O, HHC and THCP products are excluded from the state hemp definition and cannot be sold here at all.

The 2025 session was the friendliest the program has seen: lozenges, telehealth certifications, two-year cards and a one-gram concentrate cap all landed on August 1, 2025, and Senate Bill 2308 dissolved the Medical Marijuana Advisory Board. What did not change is the statutory cap of eight stores, so no new licenses are in play. The pressure now comes from outside: Minnesota licensed retail opened in September 2025 and tribal stores sit minutes from Fargo and Grand Forks, while a federal hemp redefinition signed in November 2025 takes effect November 12, 2026 and will pull most remaining intoxicating hemp products off shelves nationally.
