Overview
West Virginia passed the Medical Cannabis Act (Senate Bill 386) in April 2017, becoming the 29th state to legalize medical marijuana. After years of regulatory delays, the first dispensary finally opened in Morgantown in November 2021.
As of January 2026, West Virginia has over 65 licensed medical cannabis dispensaries serving more than 35,000 registered patients. The program is regulated by the West Virginia Office of Medical Cannabis (OMC).
Available product forms include flower (dry leaf), vape cartridges, concentrates, tinctures, topicals, pills, and dermal patches. Notably, edibles are NOT permitted for sale, though patients can infuse their own. Smoking cannabis is also prohibited - patients must vaporize flower.
The program requires patients to have one of several qualifying serious medical conditions and obtain certification from a registered physician. Telemedicine evaluations are permitted, making access convenient throughout the state's rural areas.
Recreational cannabis remains illegal in West Virginia, with possession penalties among the harshest in the nation. Several bills to legalize adult-use cannabis have been introduced but none have advanced.
West Virginia borders five states: Ohio (recreational), Pennsylvania (medical), Maryland (recreational), Virginia (recreational), and Kentucky (medical). Despite this, transporting cannabis across state lines remains federally illegal.

How Access & Delivery Work
Cannabis delivery is NOT currently permitted in West Virginia. All purchases must be made in-person at licensed dispensaries.
Patients can place orders online for in-store pickup at many dispensaries, but the product must be collected in person. Caregivers may pick up orders on behalf of registered patients.
This can be challenging in West Virginia's rural, mountainous terrain where some patients live far from dispensaries. The state continues to evaluate potential delivery options.
For disabled patients, registering a caregiver is recommended so they can make dispensary trips on your behalf.
