Overview

Ohio legalized recreational cannabis in November 2023 when voters passed Issue 2, making it the 24th state to legalize adult-use. Recreational sales began August 2024 through existing medical dispensaries, with the market expanding rapidly.

Adults 21+ can purchase from licensed dispensaries. Ohio's medical program (established 2016) provides the infrastructure, with many dispensaries now serving both markets. Medical patients access additional products and may have purchase advantages during high-demand periods.

Taxes: 10% state excise tax on recreational purchases. Medical purchases are not subject to this excise tax. Total effective rate with sales tax: ~15-17% for recreational.

Home cultivation: Legal for adults 21+ (up to 6 plants per person, 12 per household). Plants must be in a secure, enclosed space not visible to the public.

Public consumption: NOT permitted. Cannabis must be consumed on private property. No consumption in vehicles, even as a passenger. Ohio is stricter than some legal states on public use.

Delivery: NOT currently legal in Ohio. All purchases must be made in-person at licensed dispensaries. This may change as regulations evolve.

How Access & Delivery Work

Delivery is NOT currently legal in Ohio. All cannabis purchases must be made in-person at licensed dispensaries with valid ID verification.

This is a significant difference from states like New York, California, or Michigan. Plan your dispensary visits accordingly—you cannot order ahead for delivery.

Some dispensaries offer online ordering for in-store pickup, which can save time. Check individual dispensary websites for pre-order options.
