Overview
CANNABIS IS FULLY ILLEGAL IN SOUTH CAROLINA
South Carolina remains one of only about 8 states in the nation without any form of medical cannabis program. All cannabis possession, sale, and cultivation is illegal with criminal penalties.
Key Points:
- NO medical marijuana program
- NO recreational legalization
- NO decriminalization
- NO dispensaries
- Possession can result in jail time
- Over 10,000 cannabis arrests in 2023 alone
The Only Exception - Julian's Law (2014):
Patients with Lennox-Gastaut syndrome, Dravet syndrome, or refractory epilepsy may possess low-THC CBD oil (no more than 0.9% THC, at least 15% CBD) with a physician's recommendation. This is an extremely narrow exception and does NOT constitute a medical cannabis program.
Hemp/CBD:
Hemp-derived CBD products with no more than 0.3% THC are legal under the South Carolina Hemp Farming Act. However, any product exceeding that limit is treated as marijuana with criminal penalties.
Legislative Efforts:
The South Carolina Compassionate Care Act has been introduced multiple times. It has passed the Senate but repeatedly died in the House. The 2025 version (S.53) is currently under consideration.

Buying Across State Lines
South Carolina is surrounded by states with restrictive cannabis laws:
NORTH CAROLINA (North): No medical program. Decriminalized small amounts. Still illegal.
GEORGIA (South/West): Very limited medical program (non-functional). Cannabis illegal.
VIRGINIA (North): Recreational LEGAL since 2021 but NO retail sales yet. Home grow allowed in VA. DO NOT bring any cannabis to South Carolina - it becomes illegal at the state line.
FLORIDA (Far South): Medical only with FL card. Out-of-state cards not accepted.
Federal Law:
Transporting cannabis across state lines is a federal crime regardless of the laws in either state. This applies even between two legal states.
Tourists:
If you are visiting from a legal state (Colorado, California, etc.), you must leave ALL cannabis products at home. South Carolina law applies to everyone within its borders regardless of residency.
Myrtle Beach / Hilton Head Visitors:
Popular tourist destinations have the same laws. Do not assume tolerance in vacation areas.
