Overview

Missouri legalized adult-use cannabis through Amendment 3, a constitutional amendment voters passed on November 8, 2022. Sales opened February 3, 2023, and by September 2026 the market has matured into one of the busiest in the Midwest, with existing medical dispensaries converting to comprehensive (medical + recreational) licenses and a wave of microbusiness stores rolling out through 2024 and 2025.

The Division of Cannabis Regulation (DCR), housed under the Missouri Department of Health and Senior Services, licenses and inspects every cultivator, manufacturer, and dispensary in the state. Adults 21+ can walk into a comprehensive dispensary with just an ID - no medical card required - and buy up to 3 oz per transaction. Registered medical patients keep their own purchase allowances and pay lower taxes on qualifying purchases.

Checkout tax is a 6% state cannabis sales tax layered on top of regular state and local sales tax, plus up to 3% in local cannabis tax where voters approved it - so total tax at the register commonly lands in the 15-20% range once you count Missouri's base sales tax. Licensed dispensaries can deliver recreational and medical orders directly to eligible adults, though delivery hours, minimums, and coverage still vary store to store, and no dispensary can deliver to more than two people at the same address in one day without prepayment.

The biggest 2026 change is the Intoxicating Cannabinoid Control Act (HB 2641), signed by Governor Kehoe on April 23, 2026 and effective November 12, 2026. It pulls THC seltzers, delta-8 gummies, and other intoxicating hemp products out of gas stations, smoke shops, and bars statewide, caps any hemp product at 0.4 milligrams of THC per container, and hands what is left to marijuana licensees under the same testing, packaging, and 21+ rules. Because those marijuana licenses are capped and closed to existing hemp businesses, the practical effect is a ban rather than a transfer. A federal lawsuit brought by Missouri hemp companies was still pending, with no injunction granted, as of late August 2026.

How Access & Delivery Work

Every comprehensive (rec + medical) dispensary in Missouri is legally allowed to deliver, but it is not universal in practice - smaller towns and stores without a dedicated driver often stick to pickup only. Where delivery exists, expect a 1-3 hour window, a minimum order between $40-75, and ID checks at the door just like an in-store sale.

State rule caps delivery at two customers per address per day unless the order is prepaid online, which is meant to stop informal resale. Medical patients and caregivers get the same delivery access as recreational customers, plus their usual tax break on qualifying purchases. Always confirm delivery is actually running in your specific city before counting on it - check the dispensary site or call ahead.

Balms, salves, and lotions are widely stocked for localized soreness and do not produce a high since they are not meant to enter the bloodstream. $20-45 depending on size and THC/CBD ratio.
